Inama y’Inteko Nkuru zidasanzwe ishobora kandi gutumirwa n’Umunyamabanga Mukuru wa PDI kubera impamvu zikurikira: • Kuba Perezida naba Visi Perezida bombi baranze gutumira inama y’Inteko Nkuru isanzwe igihe cyayo kikaba kimaze kurengaho amezi atandatu (6); • Kuba byizewe ko badashobora kuboneka kandi igihe kirenze. Iyo Umunyamabanga Mukuru wa PDI atumiye inama y’Inteko Nkuru ni nawe uyiyobora keretse gusa inama yatumiye abisabwe na Perezida cyangwa Visi Perezida ba PDI kandi bakayibonekamo umunsi yateranye. Iyo inama itumiwe n’Umunyamabanga Mukuru akaba ari nawe uyiyobora, yitoramo umwanditsi. Ingingo ya 33: Abagize Inteko y’Intara ya PDI Inteko y’Intara ya PDI igizwe n’abayoboke makumyabiri (20) baturuka muri iyo Ntara, batorwa n’abayoboke ba PDI muri iyo Ntara/Umujyi wa Kigali. Ayo matora ayoborwa n’intumwa ya Komite Nyobozi. Komite Nyobozi niyo itanga umukandida ku mwanya w’Umuhuzabikorwa ku rwego rwa buri Ntara/Umujyi wa Kigali akemezwa n’Inteko ya buri Ntara/Umujyi wa Kigali. Iyo uwatanzwe atemejwe, Komite Nyobozi itanga undi mu gihe kitarenze iminsi mirongo itatu (30). Ingingo ya 34: Amatora y’abagize Inteko y’Intara ya PDI Umuhuzabikorwa wa PDI ku rwego rw’Intara afatanije na Komite Nyobozi, batumira inama igomba kuba irimo abayoboke nibura makumyabiri (20) b’inyangamugayo kandi batanga imisanzu ya PDI; nta wemerewe gutorwa afite ibirarane by’imisanzu. Manda z’abayobozi b’inzego za PDI basanzwe mu mirimo igihe cy’iyemezwa ry’aya Mategeko Shingiro zubahiriza umunsi batoreweho. Ubuyobozi bwa PDI busabwa kuzuza inzego ziteganwa n’Amategeko Shingiro agenga PDI mu gihe kitarenze amezi atandatu (6) iri tegeko shingiro ritangajwe mu Igazeti ya Leta ya Repubulika y’u Rwanda. Kigali, kuwa 11 Ugushyingo 2017 Sheikh HARERIMANA Mussa Fazil Perezida wa PDI STATUTES OF THE IDEAL DEMOCRATIC PARTY (PDI) FIRST REVISION OF 11/11/2017 OF THE STATUTES OF THE IDEAL DEMOCRATIC PARTY « PDI » PREAMBLE We, the signatories of the present Statutes, being fully mindful of the darkest moments that marked the history of Rwanda as a result of bad governance that culminated in the genocide against the Tutsi; Recognizing the need to promote and consolidate true democracy in our country for we strongly believe that there is no doubting the fact it is the pillar of justice, good governance and sustainable development; Pursuant to the Constitution of the Republic of Rwanda of 2003 revised in 2015, especially in Articles 52, 53 and 54; Pursuant to Organic Law no. 10/2013/OL of 11 July 2013 governing political organizations and politicians as amended to date; 
The Congress of the Ideal Democratic Party – PDI of 3 August 2013, after consideration of the Statutes of PDI and revision thereof in line with the provisions of Organic Law no. 10/2013/OL of 11 July 2013 governing political organizations and politicians, especially in articles 10, 12, 14, 17, 18, 23 and 55; 

ADOPT: CHAPTER ONE: CREATION OF A POLITICAL ORGANIZATION AND ITS SYMBOLS Section One: Name, mission, head office and seal Article one: Name There is hereby created for an indefinite period of time a political organization called “IDEAL DEMOCRATIC PARTY” -PDI hereinafter referred to as « PDI». 
 Article 2: Mission PDI mission is to always remain exemplary in terms of promoting democracy and the nation’s best interests, giving priority to equality, peace and development. Article 3: PDI Head Office PDI head office shall be located in the City of Kigali, the capital of the Republic of Rwanda. If necessary, it may be transferred to any other place on the territory of the Republic of Rwanda with the approval of the PDI Congress. Article 4: PDI emblems PDI emblems consists of a white rectangle, inside of which is nestled a green scale. The rectangle represents the all-out unity of Rwandans. The white represents peace which rests on civic education. The scale represents equal opportunities for all segments of the Rwandan population towards unhindered participation in all aspects of national life. The green symbolizes development centered on the role of population and national sovereignty. 
 Section 2 : Guiding Principles and major activities of PDI Article 5: Guiding principles Guiding Principles and major activities of PDI are the following: • All Rwandans enjoy equal rights in their country, making it necessary for each of them to love and sacrifice themselves for their country and look after its best interests and those of all Rwandans without any discrimination whatsoever; • All Rwandans are equal before the law. PDI is committed to educating all Rwandans to fight tirelessly any form of injustice and discrimination. PDI particularly undertakes to work assiduously to see the total eradication of genocide ideology in Rwanda, in the region and worldwide; • Power is a mandate received from God. Power is granted by the people by virtue of the Constitution of each country that prohibits any form of exclusion or restriction on the freedom of religion or belief and self-fulfillment or any other restriction contrary to internationally recognized human rights principles; • Economic and development policy must be people-oriented and contribute to increasing people’s wealth allowing thus avoiding anything that may give rise to exploding inequalities between rich and poor; • The living conditions of every Rwandan should constantly get improved. This being so, it is imperative to further the fight against ignorance and poverty whilst ensuring the equitable sharing of national wealth and avoiding greed, waste and bragging; • The progress of the Rwandan citizen in particular and that of the nation in general can only be acquired through his/her work and all the things that come with it; • Rwandan culture based on honor, integrity, courage, obedience to parents and adults, frankness and sincerity, mutual support towards conducting self-reliance activities, tolerance and humility and other positive values must be developed and strengthened. Equally as important is the need to combat and eradicate bad practice of slavishly flattering, use of illicit drugs, drunkenness and prostitution that fuel the spread of endemic diseases; • Relations with foreign countries must be based on the norms and principles that govern international politics and be forged in a reasonable fashion while constantly working to promote the best interests of the nation and those all the Rwandan diaspora; • The gender perspective should serve as the mainstay of the national life, taking into account the need to create opportunities for women as a prerequisite to attaining this goal. Article 6: Major activities of PDI PDI is committed to carry out activities that are critical to staying true to its political commitments. The main activities are: • Explain to the public its political program; • Educate its members on its political ideology and the principal laws in force in the country especially those relating to the rights conferred upon them and their civic duties; • Equip its members with the ability to make a thoughtful analysis of what constitutes the best interests of the nation and those of PDI and ensure those interests; • Educate its members in particular and Rwandan citizens in general on the need to engage in democracy-oriented political activities; • Immensely contribute to the promotion of good governance and the search for solutions to the country's problems by means of a thorough analysis; • Perform any other activity not contrary to the law to publicize the Political Organization and its activities throughout the country. 
 CHAPTER II: MEMBERSHIP Section One: Members, duties and rights Article 7: PDI members With the exception of members who appended their signatures on these statutes on 05 July 2003, any other person who wishes to become PDI member shall do so in writing addressed to PDI President or any other person he/she has authorized in writing. Article 8: Membership requirements PDI member must be Rwandan national who is aged at least eighteen (18) years that has not been subject to deprivation of civil and political rights following a judicial decision. PDI member must specifically base his/her daily political activities on the provisions of article 5 hereof and be characterized mainly by the following: 
 • Comply with and implement national laws and PDI statutes as well as regulations which are not contrary to those laws and statutes; • Show courtesy and humility in his/her behavior and interpersonal relationships; • Demonstrate integrity and fight injustice and corruption; • Avoid practices of adulating, slavishly flattering, and rendering others totally dependent on him/her; • Tolerate and accept those whose opinions are different from his/her own; • Work assiduously and carry out self-development activities; • Engage in constant quest for knowledge in different areas, know information about the country in particular and the world in general; • Be aware of the activities of the country and those of PDI and participate therein; • Use words and actions to confront and combat discrimination in all its forms; • Avoid gossip and distinguishing him/herself in acts that are not important for or of interest to him/her; • Look after the interests of PDI in particular and those of its members in general. He/she must strive to lead an exemplary life. 
 Article 9: Rights of PDI members Each PDI member has the following rights: • Right to vote and stand as a candidate in PDI organs as provided by law; • Be informed of the activities of PDI in accordance with the Internal Rules and Regulations; • Enjoy a protection from PDI whenever it is obvious that he/she is a victim as a result of being a member of PDI. Section 2: Misconduct and exclusion Article 10: Form of misconduct The following are form of misconduct which shall be severely punished: • Acting contrary to the provisions of the present Statutes, Internal Rules and Regulations of PDI and other instructions issued by competent organs; • Dishonouring in public leaders of PDI; • Misappropriation of national or PDI property; • Failure to pay PDI contribution; • Failure to participate in PDI activities; • Being found guilty of serious criminal acts such as genocide and genocide ideology, discrimination, sectarianism and high treason. Section 3 : Organ in charge of Mediation and Conflict Resolution Article 11: Duties of the Organ There is hereby created an organ in charge of Mediation and Conflict Resolution responsible for: Reconciling and resolve disputes, examining conflicts between PDI members and provide interpretation of PDI Statutes and Internal Rules and Regulations. PDI Statutes shall provide for modalities by which a member suspected of misconduct is given opportunity to defend him/herself; the organ in which he/she can defend him/herself and punitive procedures. Any disciplinary action against a PDI member shall only be definitive after consideration thereof by the organ in charge of Mediation and Conflict Resolution. The Organ in charge of Mediation and Conflict Resolution shall comprise of two (2) levels: Primary level and appellate level. 
 Article 12: Members of the organ at the primary level Members of the organ in charge of Mediation and Conflict Resolution at the primary level shall be the following: • Two (2) youth representatives including at least one female member elected by their peers within the Political Bureau; • Two (2) representatives from a category other than youth category including at least one female member elected by their peers within the Political Bureau; • A wise person who has been a PDI member for at least five (5) years appointed by the Executive Committee. They shall elect from among themselves a member to serve as chairperson and rapporteur. Article 13: Members of the Appellate level Appellate level shall consist of all members of the Executive Committee with the exception of a member who may be involved in the matter before the Organ, in which case he/she is required to recuse him/herself. 
However, when all or a majority of Executive Committee members are involved in the matter before the Organ, the Political Bureau shall elect from among its three (3) eldest members to serve on Committee at the first level. Those elected members shall elect from among themselves a chairperson and a rapporteur. Article 14: Terminiation of membership The grounds for loss of membership are the following: • Irrevocable resignation from PDI; • Violation of the Statutes, regulations and decisions of PDI; • Membership in another political organization ; • Being found guilty through an unappealable court decision of an offense contrary to the conduct that served as the basis for admission to PDI; • Death. Irrevocable resignation from PDI shall be done in writing. Members of PDI Congress shall tender their resignation in writing addressed to PDI President. Such resignation shall be adopted by PDI Political Bureau. Members of other PDI organs shall tender their resignation in writing addressed to PDI leader at the Provincial level. CHAPTER III: PDI ORGANS AND THEIR OPERATION Section One : Congress Article 15: Inzego za PDI PDI organs are as follows: • The Congress; • the Political Bureau; • the Executive Committee; • the Provincial Organ. PDI Congress may put in place a decentralized PDI organs and determine modalities for the appointment of their leaders and determine their responsibilities. The head office of PDI Provincial organ shall be determined by PDI Congress.
 Article 16: Members of PDI Congress The Congress is the supreme PDI organ. It shall consist of the following one hundred fifty (150) members: • Twenty-five (25) members of the Congress of each Province and the City of Kigali; • Five (5) members of the Executive Committee; • Ten (10) members appointed by the Executive Committee because of their being in higher organs of the State, civil society and the private sector; • Ten (10) members appointed by the Political Bureau on the basis of their potential importance for PDI. Article 17: Responsibilities of Congress The Congress shall have the following responsibilities: • Adopt, complement and modify the guiding principles and statutes governing PDI; • Give the Political Organization orientation and strategies which shall be utilized to attain PDI objectives; • Elect and dismiss PDI Executive Committee members; • Prospective candidates for these posts must be members of PDI Political Bureau; • Decide if PDI shall participate in elections; determine posts to contest, candidates who shall contest those posts and campaign modalities. If PDI decides to contest elections in coalition with another Political Organization, provisions in this paragraph shall be based on mutual understanding between the leaders of the two political organizations; • Adopt the budget and annual activities report of PDI; • Take decisions on other problems in conformity with the provisions of these Statutes or the Internal Rules and Regulations; • Provide guidelines the Political Bureau shall base on in establishing PDI partnership and cooperation with other parties authorized to operate in the country or those in foreign countries with similar political ideology in the interest of the country and PDI; Article 18: Frencency of the meetings of the PDI Congress PDI Congress shall hold its ordinary meetings once a year. It may also be convened in extra ordinary meetings when necessary. Ordinary Congress meetings shall be convened and chaired by PDI President. In his/her absence they shall be convened by PDI First Vice President in charge of governance and justice. In his /her absence they shall be convened by the PDI Second Vice President in charge of economic affairs and development. The Congress extraordinary meetings may also be convened by PDI Secretary General for the following reasons: • If the President and the Vice Presidents refuse to convene the Congress extraordinary meeting and the date it was due exceeds six (6) months; • When it is evident that they shall not be available and the date on which the meeting is due is pending. When PDI Secretary General convenes a Congress meeting, it is he/she who chairs it except when the meeting was convened on request by PDI President or Vice President and is present during that meeting. If the meeting is convened by the PDI Secretary General and he/she chairs it; it shall elect from among members present a rapporteur. If the Party Secretary General cannot be available, the extraordinary ordinary meeting shall be convened and chaired by his/her Assistant and elect from among members present its rapporteur. An extraordinary meeting shall be convened and chaired by PDI Secretary General or his/her Assistant only when at least a fifth (1/5) of PDI Congress members so request. Such extraordinary meeting shall examine only urgent issues. Section 2: Political Bureau Article 19: Members of PDI Political Bureau The Political Bureau is composed of the following thirty-two (32) members: • Five (5) members of the Executive Committee; • The Coordinator of PDI in each Province and in the City of Kigali; • Two (2) members elected by the Congress of each Province and the City of Kigali; • The Coordinator of the Youth League and the Coordinator of the Women’s League; • Ten (10) members appointed by the Executive Committee on the basis of their potential importance for PDI. Former PDI Presidents and Vice Presidents shall also be members of the Political Bureau along with members referred to under paragraph One of this Article and continue to be members of PDI Political Bureau unless they personally choose to resign from the Political Bureau or PDI or the Congress disqualifies them due to any form of misconduct they showed in the course of the discharge of such duties. Article 20: Responsibilities of PDI Political Bureau The Political Bureau shall have the following responsibilities: • Prepare Congress meetings; • Implement Congress resolutions; • Give the Executive Committee guidelines on what should be done so that PDI can achieve its objectives. Such guidelines must not contradict with the existing laws or the political orientation of PDI; • Elect the coordinators of Permanent Commissions of the Political Bureau; • Expel from PDI any member in the Congress, in the Political Bureau or at District level if it becomes apparent that the District has failed to do so in spite of the request to do so by the Executive Committee on the basis of the Discipline Commission report; • Adopt the activities plan of the General Secretariat; • Perform such other duties as may be assigned by PDI Congress. Article 21: Frequency of Political Bureau meetings The Political Bureau shall hold an ordinary meeting every four (4) months, and shall be convened by PDI President. In his/her absence or when otherwise engaged, the Political Bureau shall be convened and chaired by the first Vice President of PDI in charge of governance and justice. In the latter’s absence or when otherwise engaged, the Bureau shall be convened and chaired by the Second Vice President in charge of Economic Affairs and Development. Should all of them be absent or otherwise engaged, the Bureau shall be convened and chaired by PDI Secretary General upon approval by a quarter (1/4) of the members of the Political Bureau. Should the Secretary General be absent or otherwise engaged, the Political Bureau shall be convened and chaired by PDI Deputy Secretary General upon approval by a quarter (1/4) of the members of the Political Bureau. Article 22: Standing Committees To better fulfill its mandate, the Political Bureau shall have the following standing committees: • The Committee on governance and justice; • The Economic and Planning Committee; • The Committee on Social Affairs and Gender. The responsibilities and functioning of the standing Committees shall be determined by the Rules of Procedure of PDI. Artcile 23: Responsibilities of Inspection Committee There is hereby established an Inspectorate of the Party consisting of an Inspector, a Deputy Inspector and a secretary. The Inspectorate shall have the following responsibilities: • Conduct the audit of the Party’s finance and property and provide advice on how best to produce the financial and property use report, prior to submission thereof to the relevant government bodies; • Supervise compliance with the regulations relating to the use of the Party’s finance and the property at all levels; • Provide guidance on how best to manage the Party’s property at all levels; • Perform such other duties as may be assigned by the Congress, the Political Bureau or the Executive Committee. The Congress may decide to increase the number of members of the Inspectorate. No Party’s property use report shall be sent to any relevant government organ without prior examination by the Party’s Inspectorate. In the discharge of its duties, the Inspectorate shall be independent and report to PDI President. PDI President may, after consultation with the Executive Committee, order the evaluation of the performance of the Inspectorate. PDI Rules of Procedure shall determine the functioning of the Inspectorate. Section 3: Executive Committee Article 24: PDI Executive Committee members PDI Executive Committee shall comprise of senior PDI leaders and its Secretaries General. PDI senior leaders are the President, First Vice President of PDI in charge of governance and justice and the Second Vice-President in charge of Economic Affairs and Development. The President shall be PDI legal representative while the First Vice President of PDI in charge of governance and justice and the Second Vice-President in charge of Economic Affairs and Development shall respectively serve as first deputy legal representative and second deputy legal representative of PDI. PDI Secretariat General shall comprise of the Secretary General, and the Deputy Secretary General. In the discharge of their duties, PDI Secretaries General shall be assisted by staff members appointed by the Executive Committee. Membership in the PDI Executive Committee shall be replaced by one of the representatives of Province / City of Kigali in the Congress and the Political Bureau. Loss of membership in PDI Executive Committee shall in no way entail the automatic loss of membership in PDI Political Bureau unless specified in the decision relating to such loss of membership. Membership in PDI Executive Committee shall be lost on any of the following grounds: • Act contrary to the provisions of PDI Statutes, and Rules of Procedure as well as other instructions issued by competent bodies; • Publicly bring the Party’s image into disrepute; • Publicly dishonor PDI leaders; • Missapropriate PDI property; • Fail to pay PDI contributions; • Fail to participate in PDI activities; • Be convicted of serious crimes such as the crime of genocide and genocide ideology, discrimination, divisionism, high treason and embezzlement of public property. • Be appointed to an office incompatible with membership in the Executive Committee. • Death. For any election to replace a member whose term of office expires, only candidacies from members of the Political Bureau shall be admitted. Article 25: Frenquency of Executive Committee meetings The Executive Committee shall hold an ordinary meeting once in every month. Also, it shall be convened and chaired by PDI President or, in his/her absence or when otherwise engaged, by the first Vice President in charge of Governance and Justice. Should both of them be absent or otherwise engaged, the Executive Committee shall be convened and chaired by the second Vice President in charge of Economic Affairs and Development. The Executive Committee shall prepare the meeting of the Political Bureau and the Congress, which shall bring together chairpersons of the Standing Committees, the Inspector and the chairperson of the Arbitration Committee. Decisions of the Extended Executive Committee shall be adopted only by members of the Executive Committee. Article 26: Responsibilites of the Executive Committee The Executive Committee shall have the following duties: • Give the Secretariat General instructions as to the implementation of the decisions of the higher organs of PDI; • Appoint and remove from office staff of PDI in accordance with the Internal Rules and Regulations; • Prepare the meeting of the Congress and that of the Political Bureau; • Supervise activities of the General Secretariat of PDI. Section 4: Duties of members of the Executive Committee Article 27: Duties of PDI President PDI President shall have the following duties: • Represent and serve as the spokesperson of PDI; • Convene and chair the meetings of Congress, those of the Political Bureau and those of the Executive Committee; • Monitor the implementation of the resolutions of Congress and those of the Political Bureau and the general line of PDI; • Table the annual report before Congress; • Submit activity reports to the General Secretariat which in turn submits to the Executive Committee, the Political Bureau and the Congress; • Provide guidance to the Secretariat as it relates to the analysis of documents sent to PDI and identification of the organs to which they are addressed. Article 28: Duties of the first Vice President in charge of Governance and Justice The first Vice President in charge of Governance and Justice shall have the following duties: • Assist PDI President and deputize for him/her in his/her absence or when otherwise engaged; • Conduct and analyze research on governance policies related to PDI political program; • Make follow-up on the implementation of the fundamental principles set out in Article 5 of the Party Statutes and PDI main activities; • Monitor relationships between PDI and other recognized political organizations in Rwanda; • Perform such other duties relevant to his/her office as may be assigned by the Party Congress, Political Bureau and the Executive Committee. Article 29: Duties of the second Vice President in charge of economic affairs and development The second Vice President in charge of economic affairs and development has the following attributions: • Assist PDI President and deputize for him/her should both PDI President and Vice President whose main one of main duties are to deputize for PDI President be absent or otherwise engaged; • Conduct and analyze research on economic policies and good management of public affairs in relation to PDI political program; • Make follow-up on PDI property management and development activities; • Make follow-up on the preparation, execution and management of PDI budget; • Perform such other duties relevant to his/her office as may be assigned to him/her by PDI Congress, Political Bureau and Executive Committee. Article 30: Duties of the PDI Secretary General PDI Secretary General shall have the following duties: 
 • Head the General Secretariat of PDI; • Submit the report of the General Secretariat of the Executive Committee; • Coordinate activities of the Standing Committees and those of the General Secretariat; • Prepare documents for the Congress, the Political Bureau and the Executive Committee; • Archive documents, audio recording media and other items recalling the history of the activities PDI; • Attend to issues of information and communication. Article 31: Duties of the Deputy Secretary General The Deputy Secretary General shall have the following duties: • Assist the Secretary General in the discharge of all his/her duties; • Deputize for the Secretary General in his/her absence. PDI General Secretariat shall be responsible for the daily operation of PDI. The organization and functioning of the General Secretariat shall be determined by the PDI Political Bureau. Section 5 : Provincial Congress : Article 32: Responsibilities of the Provincial Congress The Provincial Congress shall be responsible for the daily operation of PDI in the Province. It shall be specifically responsible for the following: • Elect the representatives of the Province within the Political Bureau; • Keep the register of PDI members at the Provincial or City of Kigali level; • Collect the contributions of PDI members at this level; • Perform such other duties as may be assigned by the Congress or the Political Bureau. The responsibilities of each member of the Provincial Bureau shall be provided under the Internal Rules and Regulations of PDI. 
 Article 33: PDI Provincial Congress members PDI Provincial Congress shall comprise of twenty (20) members from the Province concerned and elected by PDI members in the Province / City of Kigali. Such elections shall be conducted by the Executive Committee, which nominates a candidate for the post of Coordinator in each Province / City of Kigali to be approved by the Congress of each Province / City of Kigali. If the nominee is not approved, the Executive Committee shall nominate another candidate within a period not exceeding thirty (30) days. Article 34: Elections of PDI Provincial Congress members In collaboration with the Executive Committee, PDI Coordinator shall convene a meeting bringing together at least twenty (20) members of integrity and who regularly pay their contributions. Arrears of contributions shall entail the loss of the right to stand as a candidate. When the number of members present required participating in the election is more than twenty (20), but not exceeding forty (40), all members present shall be entitled to vote. When the number of members present is greater than forty (40), all the members present shall elect from among themselves forty (40) members having received the most votes who in turn shall elect from among themselves nineteen (19) members who shall make up the Provincial Congress along with the Provincial Coordinator. Modalities for the election shall be provided under the Internal Rules and Regulations of PDI. Article 35: Bureau at the Province / City of Kigali level members Members of the Provincial Congress shall elect from among themselves four (4) members, including a young person, a woman and two advisers. The elected members shall make up PDI Bureau at the Province / City of Kigali along with the Coordinator. The Bureau at the Province / City of Kigali level shall elect from among its members a Deputy Coordinator, a Secretary and two Advisers. 
 The Coordinator and the Secretary must be domiciled in the Province. CHAPTER IV: MEETINGS OF PDI ORGANS Article 36:PDI meetings Each PDI organ shall hold ordinary meetings. It may also hold extraordinary meetings. The Internal Rules and Regulations of PDI shall determine procedures for convening and chairing these meetings. Article 37: Subject to the provisions of articles 44, 45 and 46 hereof, the other PDI organs may meet only when at least ½ +1 of their members are present. If, after notice duly given, the quorum is not reached; a second notice shall be given within the two following weeks and members present shall validly deliberate regardless of the attendance quorum provided under this article. 
 Article 38: Decision- making process at PDI meetings Decisions of the meetings of PDI organs shall be taken by consensus of the members unless otherwise provided by the present Statutes. In the absence of consensus on any resolution, it shall be taken by an absolute majority of members present. Each PDI organ may invite to its meetings people who can help it better fulfill its responsibilities. CHAPTER V: PROPERTY Article 39: Sources of PDI assets The property of PDI shall come from the following sources: • Members’ contributions; • Donations and bequests; • Assets and income-generating activities of PDI; • State subsidies. PDI Congress shall determine modalities for the payment and collection of members’ contributions. Article 40: Management of PDI assets The Internal Rules and Regulations of PDI shall determine modalities for the management and disbursement of PDI resources sets the accounting standards to be followed by PDI organs and determine measures to be taken against those who are guilty of bad management of PDI resources. 
CHAPTER VI: TRANSITIONAL AND MISCELLANEOUS AND FINAL PROVISIONS Article 41: Continuation of duties for incumbent leaders of PDI As part of filling vacancies within the organs provided under the present PDI Statutes, the people in positions that are not removed shall continue to occupy their respective positions. Article 42: Term of office for members of PDI organs Members of PDI organs shall be elected for a term of five (5) years renewable.

 The term for PDI officials holding office on the date of the adoption of the present Statutes shall continue holding office and complete their term. 
PDI leadership shall be required to fill vacancies within the organs provided under the present Statutes within a period not exceeding six (6) months following its publication in the Official Gazette of the Republic of Rwanda.
 Article 43: PDI organ responsible for adopting its Internal Rules and Regulations The Internal Rules and Regulations adopted by PDI Congress shall explain in detail the present Statutes and define modalities for the application of their provisions. Article 44: Amendment of PDI Statutes The revision of PDI Statutes shall be decided by three-fourths (3/4) members of Congress present at the meeting examining the revision and must bring together at least two thirds (2/3) of members. If, after notice duly given, the quorum is not reached; a second notice shall be given and members present shall validly deliberate only when ½ + 1 members of Congress are present. Article 45: Amendment of PDI Internal Rules and Regulations The revision of PDI Internal Rules and Regulations shall be decided by two-thirds (2/3) of members of Congress present at the meeting examining the revision and must bring together at least 3/5 of the members. If, after notice duly given, the quorum is not reached; a second notice shall be given and all members present validly deliberate regardless of quorum provided under this article. 
Article 46: PDI Congress’s resolution dissolving PDI shall be made by four fifths (4/5) of its members present at the meeting of the Congress bringing together at least three quarters (3/4) of its members. Article 47: Delegation of powers Each PDI organ may temporarily delegate its powers to another lower PDI organ. The instrument of delegation shall indicate the delegated powers. 
 Article  48: Collaborative relations with other political organizations PDI's decision to enter coalition with one or several political organizations for elections or for the conquest of power shall be taken by PDI Political Bureau.
 The decision to merge PDI with another political organization shall be taken by the meeting of the Congress in the same conditions as those applicable to the dissolution of PDI. Article 49: Dissolution of PDI In case of dissolution of PDI, its property and assets shall devolve upon another political organization or a non-profit organization determined by PDI Political Bureau. Article 50: Matters not provided in the Constitution of the Republic of Rwanda, Organic Law governing political organizations and politicians, by the present Statutes and the Internal Rules and Regulations of PDI, decisions of PDI organs shall apply taking into account the hierarchy of these organs. Article 51: Entry into force of the present statutes The present Statutes shall come into force on the date of their approval by the competent State organ. Kigali, on 11 November 2017 Sheikh HARERIMANA Mussa Fazil PDI President STATUTS DU PARTI DÉMOCRATE IDÉAL (PDI) PREMIERE REVISION DU 11/11/2017 DES STATUTS DU PARTI DÉMOCRATE IDÉAL « PDI » PRÉAMBULE Nous, signataires des présents Statuts, tenant pleinement compte des moments sombres qui ont jalonné l’histoire du Rwanda à cause de la mauvaise gouvernance qui a culminé avec le génocide perpétré contre les Tutsi ; Conscients de la nécessité de promouvoir et de consolider la vraie démocratie dans notre pays car nous sommes convaincus qu’elle est le pilier incontestable de la justice, de la bonne gouvernance et du développement durable ; Vu la Constitution de la République du Rwanda de 2003 révisée en 2015, spécialement en ses articles 52, 53 et 54; Vu la Loi Organique n° 10/2013/OL du 11 juillet 2013 portant organisation des formations politiques et des politiciens comme modifié jusqu’à ce jour; Le Congrès du Parti Démocrate Idéal-PDI du 3 août 2013, après l’examen des Statuts du PDI et leur adaptation aux dispositions de la Loi Organique no. 10/2013/OL du 11 juillet 2013 portant organisation des formations politiques et les politiciens, spécialement en ses articles 10, 12, 14, 17, 18, 23 et 55 ; ADOPTONS: CHAPITRE PREMIER: CRÉATION D’UNE FORMATION POLITIQUE ET SES SYMBOLES Section première: Dénomination, mission, siège et sceau Article premier: Dénomination Il est créé pour une durée indéterminée une formation politique dénommée « PARTI DÉMOCRATE IDÉAL » -PDI ci-après dénommée « PDI». Article 2: Mission La mission du PDI consiste à être toujours exemplaire dans la promotion de la démocratie et des intérêts supérieurs de la nation, la priorité étant accordée à l’égalité, à la paix et au développement. Article 3: Siège du PDI Le siège du PDI est établi dans la Ville de Kigali, Capitale de la République du Rwanda. Il peut, en cas de nécessité, être transféré en tout autre lieu du territoire de la République du Rwanda sur approbation du Congrès du PDI. Article 4: Armoires du PDI L’emblème du PDI se compose d’un rectangle blanc à l’intérieur duquel se trouve une balance verte. Le rectangle symbolise l’unité tous azimuts des Rwandais. La couleur blanche symbolise une paix fondée sur l’éducation civique; La balance symbolise l’égalité des chances entre toutes les couches de la population rwandaise quant à la pleine participation à tous les aspects de la vie nationale. La couleur verte symbolise le développement axé sur le rôle de la population et la souveraineté nationale. Section 2 : Principes directeurs et principales activités du PDI Article 5: Principes directeurs Les principes directeurs et les principales activités politiques du PDI sont les suivants: • Tous les Rwandais jouissent des mêmes droits dans leur pays et ceci oblige chacun d’entre eux à l’amour de la patrie et à se sacrifier pour elle et à veiller à ses intérêts supérieurs et à ceux de tous les Rwandais sans discrimination aucune ; • Tous les Rwandais sont égaux devant la loi. PDI s’engage à sensibiliser tous les Rwandais à combattre sans faiblir toute forme d’injustice et de discrimination. PDI s’engage tout particulièrement à travailler à l’éradication totale de l’idéologie du génocide au Rwanda, dans la région et dans le monde entier ; • Le pouvoir est un mandat reçu de Dieu. C’est le peuple qui donne le pouvoir en vertu des dispositions de la Constitution de chaque pays qui ne tolère aucune exclusion ou restriction de la liberté de foi et de l’épanouissement individuel ou toute autre restriction contraire aux principes relatifs aux droits fondamentaux de la personne universellement reconnus ; • La politique économique et de développement doit être axée sur la population et contribuer à l’enrichissement de celle-ci tout en permettant ainsi d’éviter tout ce qui peut occasionner des inégalités criardes entre les riches et les pauvres ; • Les conditions de vie de chaque Rwandais doivent toujours s’améliorer. Cela étant, il est impératif de s’atteler à la lutte contre l’ignorance et la pauvreté en veillant au partage équitable de la richesse nationale et en évitant l’avidité, le gaspillage et la vantardise ; • Les progrès du citoyen rwandais en particulier et ceux de la nation en général ne peuvent être acquis que par son travail et tout ce qui l’accompagne ; • La culture rwandaise fondée sur l’honneur, l’intégrité, la bravoure, l’obéissance aux parents et aux adultes, la franchise et la sincérité, le soutien mutuel dans les activités d’auto-développement, la tolérance et humilité ainsi que d’autres valeurs positives doivent être développées et renforcées. Il importe également de combattre et d’éradiquer la mauvaise pratique de faire de la lèche, d’usage de drogues illicites, l’ivrognerie et la prostitution qui favorisent la propagation des maladies endémiques ; • Les relations avec les pays étrangers doivent se fonder sur les principes et les normes de la politique internationale et se tisser de manière raisonnable tout en veillant toujours à promouvoir les intérêts supérieurs de la nation et de toute la diaspora rwandaise ; • La perspective sexospécifique doit servir de pilier principal de la vie nationale en tenant compte des chances à donner aux femmes en vue d’atteindre ce but. Article 6: Principales activités du PDI PDI est engagé à réaliser les activités lui permettant d’accomplir ses engagements politiques. Les principales activités sont les suivantes : • Expliquer à la population son programme politique; • Éduquer ses membres sur l’idéologie politique et sur les principales lois en vigueur dans le pays surtout celles relatives aux droits qui leur sont reconnus ainsi que sur leurs devoirs en tant que citoyens; • Inculquer à ses membres des capacités à faire une analyse judicieuse de ce qui constitue les intérêts supérieurs de la nation et du PDI et à veiller à ces intérêts ; • Éduquer ses membres en particulier et les citoyens rwandais en général sur la nécessité de mener des activités politiques axées sur la démocratie ; • Contribuer considérablement à la promotion de la bonne gouvernance et à la recherche des solutions aux problèmes du pays à l’aide d’une analyse approfondie ; • Réaliser toute autre activité non contraire à la loi visant à faire connaître la formation politique et ses activités dans le pays. CHAPITRE II: MEMBRES DU PDI Section première: Membres, devoirs et droits Article 7: Membres du PDI À l’exception des personnes ayant apposé leurs signatures aux présents Statuts en date du 05/07/2003, toute autre personne qui désire être membre du PDI doit adresser leur demande écrite au Président du PDI ou à toute autre personne munie du mandat écrit du Président. Article 8: Conditions d’adhésion Un membre du PDI doit être de nationalité rwandaise et âgé d’au moins dix-huit (18) ans qui n’a pas fait l’objet de déchéance des droits civils et politiques par décision judiciaire. Un membre du PDI doit particulièrement baser ses activités politiques quotidiennes sur les dispositions de l’article 5 des présents Statuts et se caractériser principalement de ce qui suit : • Respecter et appliquer les lois du pays et les statuts du PDI ainsi que les règlements non contraires à ces lois et statuts ; • Faire preuve de politesse et d’humilité dans ses comportements et dans ses relations interpersonnelles ; • Faire preuve d’intégrité et combattre l’injustice et la corruption ; • Éviter les pratiques de faire de la lèche, flatter servillement et soumettre autrui à la dépendance; • Tolérer et accepter les opinions différentes des siennes; • Faire preuve de travail assidû et s’atteler aux activités d’auto-développement; • Être toujours en quête de connaissances dans différents domaines, connaître des informations concernant le pays en particulier et le monde en général ; • Suivre les activités du pays et celles du PDI et y participer; • User des paroles et des actes pour affronter et combattre la discrimination sous toutes ses formes ; • Éviter des commérages et de se faire remarquer dans les actes qui ne présentent pas une importance ou un intérêt pour lui ; • Veiller aux intérêts du PDI en particulier et de ses membres en général. Il doit s’évertuer à mener une vie exemplaire. Article 9: Droits du membre du PDI Chaque membre du PDI jouit des droits suivants: • Droit de vote et d’éligibilité au sein des organes du PDI dans les conditions prévues par la loi; • Être informé des activités du PDI dans les conditions prévues par le Règlement d’Ordre Intérieur; • Jouir d’une protection du PDI chaque fois qu’il est évident qu’il est victime à la suite de son adhésion au PDI. Section 2: Fautes et exclusion Article 10: Les fautes Les fautes qui sont sévèrement punies sont les suivantes : • Agir en contravention des dispositions des présents statuts, de celles du Règlement d’ordre intérieur du PDI et d’autres instructions édictées par les organes compétents ; • Déshonorer publiquement les responsables du PDI; • Détourner le patrimoine du Pays ou celui du PDI; • Ne pas s’acquitter de la cotisation du PDI; • Ne pas participer aux activités du PDI; • Être reconnu coupable des actes criminels graves tels que le crime de génocide et d’idéologie du génocide, le crime de discrimination, de divisionnisme et de haute trahison. Section 3 : Organe chargé de la médiation et la résolution des conflits Article 11: Devoirs d’ un Organe Il est créé un Organe chargé de la médiation et la résolution des conflits chargé de: Concilier et régler les litiges, examiner les conflits entre les membres du PDI et assurer l’interprétation des Statuts et règlements du PDI. Les Statuts du PDI prévoient les modalités de défense du membre poursuivi pour faute, l’organe de recours ainsi que les modalités de punition. Toute sanction prise à l’encontre d’un membre du PDI ne peut être définitive qu’après son examen par lo’rgane chargé de la médiation et la résolution des conflits. L’Organe chargé de la médiation et la résolution des conflits comprend deux (2) instances: Première instance et instance de recours. Article 12: Membres de l‘organe en première instance Les membres de l‘organe chargé de la médiation et la résolution des conflits en première instance sont les suivants: • Deux (2) représentants de la jeunesse dont au moins un membre de sexe féminin élus par leurs pairs au sein du Bureau Politique; • Deux (2) représentants relevant d’une catégorie autre que celle de la jeunesse dont au moins un membre de sexe féminin élus par leurs pairs au sein du Bureau Politique; • Une personne sage qui est déjà membre du PDI pour au moins cinq (5) ans nommé par le comité Exécutif. Ils élisent en leur sein un président et un rapporteur. Article 13: Membres de l’instance de recours L’instance de recours est constituée de tous les membres du Comité Exécutif à l’exception d’un membre qui serait visé par la question dont est saisi le Comité, auquel cas il lui est enjoint de se retirer. Toutefois, lorsque l’ensemble ou la majorité des membres du Comité Exécutif sont visés par la question dont est saisi le Comité, le Bureau Politique élit en son sein ses trois (3) membres les plus âgés pour siéger au Comité en première instance. Les membres élus élisent en leur sein un président et un rapporteur. Article 14: Cessation d’adhésion La cessation d’adhésion d’un membre intervient dans les cas suivants : • Démission définitive du PDI; • Violation des lois et des décisions du PDI; • Adhésion à une autre formation politique; • Être reconnu coupable par décision judiciaire devenue définitive d’une infraction contraire à la bonne conduite qui a servi de base pour son admission au PDI; • Décès. La démission définitive du PDI est faite par écrit. Les membres du Congrès du PDI démissionnent par écrit adressé au Président du PDI et leur démission est adoptée par les membres du Bureau Politique du PDI. Les membres des autres organes du PDI démissionnent par écrit adressé aux dirigeants du PDI au niveau de la Province. CHAPITRE III: ORGANES DU PDI ET LEUR FONCTIONNEMENT Section première: Congrès Article 15: Organes du PDI Les organes du PDI sont les suivants: • le Congrès ; • le Bureau Politique ; • le Comité Exécutif ; • l’Organe de Province. Le Congrès du PDI peut mettre en place les organes de base du PDI et déterminer les modalités de nomination de leurs responsables et définir leurs attributions. Le siège de l’organe de Province du PDI est déterminé par le Congrès du PDI. Article 16: Membres du Congrès du PDI Le Congrès est l’organe suprême du PDI. Il est composé de cent cinquante (150) membres suivants : • Vingt-cinq (25) membres du Congrès de chaque Province et de la Ville de Kigali; • Cinq (5) membres du Comité Exécutif; • Dix (10) membres nommés par le Comité Exécutif parce qu’ils sont dans les organes supérieurs de l’État, de la société civile ou du secteur privé ; • Dix (10) membres nommés par le Bureau Politique sur base de l’importance éventuelle pour le PDI. Article 17: Attributions du congrès Le congrès est chargé de ce qui suit: • Adopter, compléter et modifier les principes directeurs et les statuts du PDI; • Donner l’orientation politique et les stratégies à suivre pour atteindre les objectifs du PDI; • Elire et révoquer le Comité Exécutif du PDI ; • Les candidats à ces postes doivent être parmi les membres du Bureau Politique du PDI ; • Décider de la participation du PDI aux élections, des postes à briguer, des candidats à proposer à ces postes et les modalités de la campagne. Lorsque PDI décide de coaliser avec une autre formation politique lors des élections, les dispositions de la présente phrase se basent sur la convention entre les dirigeants de deux formations politique ; • Adopter le budget et le rapport annuel d’activités du PDI ; • Prendre des décisions sur d’autres questions en conformité avec les dispositions des présents statuts ou du Règlement d’ordre intérieur ; • Donner la ligne directrice du Bureau Politique dans le partenariat et la coopération du PDI et les autres formations politiques agréés au Rwanda ou ceux des pays étrangers de même idéologie politique dans le but d’intérêt du Pays et celui du PDI; Article 18: Fréquence des réunions du Congrès du PDI Le Congrès du PDI tient ses réunions ordinaires une fois par an, et il est également convoqué en réunions extraordinaires chaque fois que de besoin. Les réunions ordinaires du Congrès sont convoquées et dirigées par le Président du PDI. Lorsqu’il est absent ou empêché, elles sont convoquées et dirigées par le premiere Vice-président du PDI en charge de la gouvernance et de la justice. Lorsqu’il est absent ou empêché, elles sont convoquées et dirigées par le deuxième Vice-Président chargé des affaires économiques et du développement. Les réunions extraordinaires du Congrès peuvent également être convoquées par le Secrétaire Général du PDI pour des raisons suivantes : • Lorsque le Président et les Vice-Présidents ont refusé de convoquer la réunion ordinaire du Congrès et que sa date est dépassée de six (6) mois ; • Lorsque leur empêchement est évident alors que le retard s’affiche. Lorsque le Secrétaire Général du PDI convoque la Congrès, c’est lui-même qui la dirige, sauf lorsqu’il l’a convoqué sur demande du Président ou du Vice-Président du PDI et lorsqu’ils sont présents à la réunion. Lorsqu’elle est convoquée et dirigée par le Secrétaire Général du PDI, la réunion élit en son sein un rapporteur. Lorsque le Secrétaire Général est à son tour empêché, la réunion extraordinaire est convoqué est dirigée par le Secrétaire Général Adjoint et élit en son sein un rapporteur. La réunion extraordinaire est convoquée et dirigée par le Secrétaire Général ou par son Adjoint, à la demande d’un 1/5 au moins des membres du Congrès du PDI. Ladite réunion extraordinaire de traite que les points urgents. Section 2: Bureau Politique Article 19: Membres du Bureau Politique du PDI Le Bureau Politique est composé de trente-deux (32) membres suivants: • Cinq (5) membres du Comité Exécutif; • Le coordinateur du PDI dans chaque Province et dans la Ville de Kigali; • Deux (2) membres élus par le congrès de chaque Province et de la Ville de Kigali; • Le Coordinateur de la ligue des jeunes et le coordinateur de la ligue des femmes; • Dix (10) membres nommés par le Comité Exécutif sur base de leur importance éventuelle pour le PDI. Les anciens Présidents et Vice-Présidents du PDI s’ajoutent aux membres visés à l’alinéa premier du présent article et continuent d’être membres du Bureau Politique du PDI à moins qu’ils demandent eux-mêmes de démissionner du Bureau Politique ou du PDI ou que le Congrès invalide leur éligibilité au Bureau Politique à cause d’une méconduite qu’ils ont affichée dans l’exercice de ces fonctions. Article 20: Attributions du Bureau Politique du PDI Le Bureau Politique a les attributions suivantes: • Préparer la réunion du Congrès ; • Assurer le respect des résolutions de la réunion du Congrès ; • Donner au Comité Exécutif la ligne directrice des activités à mener pour atteindre les objectifs du PDI. Ladite ligne ne doit pas être contraire à la loi et à l’orientation politique du PDI; • Elire les coordinateurs des Commissions Permanentes du Bureau Politique ; • Démettre du PDI le membre du Congrès, celui du Bureau Politique et celui du niveau du District lorsque ce dernier ne peut pas le démettre alors qu’il lui est demandé par le Comité Exécutif sur base du rapport de la Commission de Discipline ; • Adopter le plan d’activités du Secrétariat Général ; • Toute autre tâche qui lui serait assigné par le Congrès du PDI. Article 21: Fréquence des réunions du Bureau Politique Le Bureau Politique se réunit une fois par quatre (4) mois en réunions ordinaires sur convocation du Président du PDI. En cas d’absence ou d’empêchement de ce dernier, le Bureau Politique est convoqué et présidé par le premier Vice-Président du PDI en charge de la gouvernance et de la justice. En cas de son absence ou de son empêchement, la réunion est convoquée et présidée par le deuxième Vice-Président chargé des affaire économiques et du développement. En cas de leur absence ou d’empêchement simultanés, le Bureau est convoqué et dirigé par le Secrétaire Général du PDI sur approbation d’un quart (1/4) des membres du Bureau Politique. Lorsque lui-même est absent ou empêché, le Bureau est convoqué et présidé par le Secrétaire Général Adjoint du PDI sur approbation d’un quart (1/4) des membres du Bureau Politique. Article 22: Commissions permanentes Pour mieux remplir ses attributions, le Bureau Politique est doté des Commissions permanentes suivantes: • Commission de la gouvernance et de la justice; • Commission Économique et de Planification; • Commission sociale et de gender. Les attributions et le fonctionnement des Commissions permanentes sont déterminés par le Règlement d’Ordre Intérieur du PDI. Article 23 : Attribution du Comité d’Inspection Il est créé un Comité d’Inspection du Parti composé d’un Inspecteur, d’un Inspecteur adjoint et d’un Secrétaire. Le Comité d’Inspection a les attributions suivantes: • Faire l’audit des finances et du patrimoine du parti et donner des conseils sur la meilleure production du rapport financier et du patrimoine avant qu’il ne soit soumis aux organes compétents de l’État; • Contrôler le respect des règlements relatifs à l’utilisation des finances et du patrimoine du Parti à tous les échelons; • Donner des conseils sur la meilleure gestion du patrimoine du Parti à tous ses échelons; • Accomplir toute autre tâche assignée par le Congrès, le Bureau Politique ou le Comité Exécutif. Le Congrès peut décider de l’augmentation du nombre de membres du Comité d’Inspection. Aucun rapport sur l’utilisation du patrimoine du Parti ne peut être envoyé à un quelconque organe compétent de l’État sans examen préalable par le Comité d’Inspection du Parti. Le Comité d’Inspection est indépendant dans l’exercice de ses attributions et fait rapport au Président du Parti. Après consultation du Comité Exécutif, le Président du Parti peut ordonner l’audit de la performance du Comité d’Inspection. Le Règlement d’Odre Intérieur du PDI détermine le fonctionnement du Comité d’Inspection. Section 3: Comité Exécutif Article 24: Membres du Comité Exécutif du PDI Le Comité Exécutif du PDI est composé des Dirigeants Supérieurs du PDI et ses Secrétaires Généraux. Les Dirigeants Supérieurs du PDI sont : le Président, le premier Vice-Président en charge de la gouvernance et de la justice et le deuxième Vice-Président chargé des affaires économiques et du développement. Le Président est le Représentant Légal ; le premier Vice-Président en charge de la gouvernance et de la justice est le Premier Représentant Légal Suppléant. Le deuxième Vice-Président chargé des affaires économiques et du développement est le deuxième Représentant Légal Suppléant du PDI. Le Secrétariat Général du PDI est composé du Secrétaire Général et du Secrétaire Général Adjoint. Dans leurs fonctions, les Secrétaires Généraux du PDI sont assistés par le personnel du PDI nommé par le Comité Exécutif. La qualité de membre du Comité Exécutif est remplacé par l’un des représentants de Province/Ville de Kigali au Congrès et au Bureau Politique. La perte de qualité de membre du Comité Exécutif du PDI n’entraîne pas d’office la perte de qualité de membre du Bureau Politique du PDI à moins que cela ne soit précisé dans la décision portant perte de cette qualité de membre. La qualité de membre du Comité Exécutif du PDI se perd dans les cas suivants: • Agir contrairement aux dispositions des Statuts, de celles du Règlement d’ordre intérieur du PDI et d’autres instructions édictées par les organes compétents ; • Ternir l’image du Parti dans le public ; • Déshonorer publiquement les responsables du PDI; • Détourner le patrimoine du PDI; • Ne pas s’acquitter de la cotisation du PDI; • Ne pas participer aux activités du PDI; • Être reconnu coupable des actes criminels graves tels que le crime de génocide et d’idéologie du génocide, le crime de discrimination, de divisionnisme, de haute trahison et de détournement des biens publics ; • Être nommé à des fonctions incompatibles avec la qualité de membre du Comité Exécutif. • Décès. Lors de l’élection de remplacement d’un membre dont le mandat vient à expiration, seules les candidatures des membres du Bureau Politique sont admises. Article 25: Fréquence des réunions du Comité Exécutif Le Comité Exécutif se réunit une fois par mois en réunions ordinaires. Il est en outre convoqué et présidé par le Président du PDI. En cas d’absence ou d’empêchement de ce dernier, il est convoqué et présidé par le premier Vice-Président en charge de la gouvernance et de la justice et par le deuxième Vice-Président chargé des affaires économiques et du développement en cas de son absence ou de son empêchement. Le Comité Exécutif prépare la réunion du Bureau Politique et du Congrès regrouoant les présidents des commissions permanentes, l’Inspecteur et le Président du Comité d’Arbitrage. Les décisions du Comité Exécutif élargi sont adoptées par les seuls membres du Comité Exécutif. Article 26: Attributions du Comité Exécutif Le Comité Exécutif a les attributions suivantes: • Donner au Secrétariat Général les instructions lui permettant de mettre en application les décisions des organes supérieurs du PDI; • Nommer et révoquer le personnel du PDI dans les conditions prévues par le Règlement d’Ordre Intérieur; • Préparer la réunion du Congrès et celle du Bureau Politique; • Superviser les activités du Secrétariat Général du PDI. Section 4: Attributions des membres du Comité Exécutif Article 27: Attributions du Président du PDI Le Président du PDI a les attributions suivantes: • Etre le représentant et le porte-parole du PDI; • Convoquer et diriger les réunions du Congrès, celles du Bureau Politique et celles du Comité Exécutif ; • Suivre de près la mise en application des résolutions du Congrès et de celles du Bureau Politique et de la ligne générale du PDI; • Présenter le rapport annuel au Congrès; • Soumettre le rapport d’activités au Secrétariat Général pour que celui-ci le soumet à son tour au Comité Exécutif, au Bureau Politique et au Congrès; • Donner au Secrétariat Général des orientations concernant l’analyse des documents envoyés au PDI et déterminer les organes auxquels ils sont destinés. Article 28: Attributions du Vice-Président en charge de la gouvernance et de la justice Le premier Vice-Président en charge de la gouvernance et de la justice a les attributions suivantes: • Assister le Président du PDI et le remplacer en cas d’absence ou d’empêchement; • Réaliser et analyser les recherches sur les politiques de gouvernance en rapport avec le programme politique du PDI; • Faire le suivi de la mise en oeuvre des principes fondamentaux prévus à l’article 5 des Statuts du Parti et des activités principales du PDI; • Faire le suivi des relations entre le PDI et d’autres formations politiques reconnues au Rwanda; • Accomplir toute autre tâche relevant de ses fonctions que le Congrès, le Bureau Politique et le Comité Exécutif du Parti pourraient lui assigner. Article 29: Attributions du deuxième Vice-Président en charge des affaires économiques et du développement Le deuxième Vice-Président en charge des affaires économiques et du développement a les attributions suivantes : • Assister le Président du PDI et le remplaçer en cas d’absence ou d’empêchement simultanés de ce dernier et du Vice-Président dont l’une des attributions principales consiste à remplacer le Président du PDI; • Réaliser et analyser des recherches sur les politique économiques et de bonne gestion de la chose publique en rapport avec le programme politique du PDI; • Faire le suivi des activités de gestion du patrimoine et de développement du Parti; • Faire le suivi de la préparation, de l’exécution et de la gestion du budget du PDI; • Accomplir toute autre tâche relevant de ses fonctions que le Congrès, le Bureau Politique et le Comité Exécutif du Parti pourrraient lui assigner. Article 30: Attributions du Secrétaire Général du PDI Le Secrétaire Général du PDI a les attributions suivantes: • Diriger le Secrétariat Général du Parti; • Présenter le rapport du Secrétariat Général au Comité Exécutif; • Coordonner les activités des Commissions permanentes et celles du Secrétariat Général ; • Élaborer les documents destinés au Congrès, au Bureau Politique et au Comité Exécutif ; • Archiver les documents, les supports audio et d’autres éléments retraçant l’histoire des activités du PDI; • S’occuper des questions d’informations et de communication. Article 31: Attributions du Secrétaire Général Adjoint Le Secrétaire Général Adjoint a les attributions suivantes: • Assister le Secrétaire Général dans l’exercice de toutes ses fonctions; • Assurer l’intérim du Secrétaire Général en cas d’absence. Le Secrétariat Général du PDI assure le fonctionnement quotidien du PDI. L’organisation et le fonctionnement du Secrétariat Général sont déterminés par le Bureau Politique du PDI. Section 5 : Congrès provincial: Article 32: Attributions du Congrès provincial Le Congrès provincial est chargé d’assurer le fonctionnement quotidien du PDI au niveau de la Province. Il est particulièrement chargé de ce qui suit : • Élire les représentants de la Province au sein du Bureau Politique; • Tenir le registre des membres du PDI au niveau de la Province ou de la Ville de Kigali ; • Collecter les cotisations des membres du PDI à ce niveau ; • Exécuter toute autre tâche qui lui serait assigné par le Congrès ou le Bureau Politique. Les attributions de chacun des membres du Bureau Provincial sont prévues au Règlement d’Ordre Intérieur du PDI. Article 33: Membres du Congrès Provincial du PDI Le Congrès Provincial du PDI est composé de vingt (20) membres issus de la Province concernée et élus par les membres du PDI dans cette Province/Ville de Kigali. Ces élections sont dirigées par le Comité Exécutif qui propose un candidat au poste de Coordinateur au niveau de chaque Province/Ville de Kigali qui doit être approuvé par le Congrès de chaque Province/Ville de Kigali. Lorsque le candidat proposé n’est pas approuvé, le Comité Exécutif propose un autre candidat dans un délai ne dépassant pas trente (30) jours. Article 34: Elections de membres du Congrès Provincial. En collaboration avec le Comité Exécutif, le Coordinateur du PDI convoque une réunion à laquelle prennent part au moins vingt (20) membres intègres et qui s’acquittent de leur cotisation. Les arriérés de cotisation emportent la perte du droit d’éligibilité. Lorsque le nombre de membres présents devant participer à l’élection est supérieur à vingt (20) mais et ne dépasse pas quarante (40), tous les membres présents sont autorisés à voter. Lorsque le nombre de membres présents est supérieur à quarante (40), tous les membres présents élisent en leur sein quarante (40) membres qui ont eu le plus de voix qui, à leur tour, élisent en leur sein dix-neuf (19) membres qui s’ajoutent au Coordinateur pour constituer le Congrès Provincial. Les modalités de vote sont déterminées par le Règlement d’Ordre Intérieur du PDI. Article 35: Membres du Bureau au niveau de la Province/Ville de Kigali Les membres du Congrès Provincial élisent en leur sein quatre (4) membres dont une personne jeune, une femme et deux conseillers. Les membres élus s’ajoutent au Coordinateur pour constituer le Bureau du PDI au niveau de la Province/Ville de Kigali. Le Bureau au niveau de la Province/Ville de Kigali élit en son sein un Coordinateur Adjoint, un Secrétaire et deux Conseillers. Le Coordinateur et le Secrétaire doivent être domiciliés dans cette Province. CHAPITRE IV: RÉUNIONS DES ORGANES DU PDI Article 36: Réunions du PDI Chaque organe du PDI tient des réunions ordinaires. Il peut également tenir des réunions extraordinaires. Le Règlement d’Ordre Intérieur du PDI détermine les modalités de convocation et de direction de ces réunions. Article 37: Sous réserve des dispositions des articles 44, 45 et 46 des présents Statuts, les autres organes du PDI ne peuvent se réunir que lorsqu’au moins ½ +1 de leurs membres sont présents. Si, après une convocation régulièrement faite, ce quorum n’est pas atteint, une seconde convocation est effectuée dans les deux semaines qui suivent et les membres présents délibèrent valablement sans tenir compte du quorum visé au présent article. Article 38: Modalites de prises des décisions des réunions Les décisions des réunions des organes du PDI sont prises par consensus des membres à moins que les présents Statuts n’en disposent autrement. À défaut de consensus sur une quelconque résolution, celle-ci est prise à la majorité absolue des membres présents. Chaque organe du PDI peut inviter à ses réunions les personnes qui peuvent l’aider à mieux remplir ses attributions. CHAPITRE V: PATRIMOINE Article 39: Sources du patrimoine du PDI Le patrimoine du PDI provient des sources suivantes : • Cotisations des membres ; • Dons et legs; • Biens et activités génératrices de revenus du PDI; • Subventions de l’État. Le Congrès du PDI détermine les modalités de paiement et de collecte des cotisations des membres. Article 40: Gestion du patrimoine du PDI Le Règlement d’Ordre Intérieur du PDI détermine les modalités de gestion et de décaissement des ressources du PDI, fixe les normes comptables devant être suivies par les organes du PDI, les mesures prises à l’encontre de ceux qui se rendent coupables de la mauvaise gestion des ressources du PDI. CHAPITRE VI: DISPOSITIONS TRANSITOIRES, DIVERSES ET FINALES Article 41: Poursuite de l’exercice de leurs fonctions par les dirigents actuels du PDI Dans le cadre de pourvoir aux postes vacants au sein des organes prévus par les présents Statuts du PDI, les personnes occupant les postes qui ne sont pas supprimés restent maintenus à leurs postes respectifs. Article 42: Mandat des membres des organes du PDI Les membres des organes du PDI sont élus pour un mandat de cinq (5) ans renouvelable. Le mandat des responsables du PDI qui sont en fonction lors de l’adoption des présents Statuts continuent d’assumer leurs fonctions et terminer leur mandat. La direction du PDI est tenue de pourvoir aux postes vacants au sein des organes prévus par les présents Statuts dans un délai ne dépassant pas six (6) mois suivant sa publication au Journal Officiel de la République du Rwanda. Article 43: Organe du PDI chargee du adoption du Règlement d’Ordre Intérieur Le Règlement d’Ordre Intérieur du PDI adopté par le Congrès du PDI explique en détails les présents Statuts et définit les modalités d’application de leurs dispositions. Article 44: Modification des Statuts du PDI La révision des Statuts du PDI est décidée par les trois quarts (3/4) des membres du Congrès présents dans la réunion statutant sur cette révision et qui doit réunir au moins les deux tiers (2/3) des membres. Lorsque ce quorum n’est pas atteint, une seconde convocation est effectuée et la réunion ne peut délibérer valablement que lorsque les ½ + 1 des membres du Congrès sont présents. Article 45: Modification du Règlement d’Ordre Intérieur du PDI La révision du Règlement d’Ordre Intérieur du PDI est décidée par les deux tiers (2/3) des membres du Congrès présents dans la réunion statuant sur cette révision et qui doit réunir au moins les 3/5 des membres. Lorsque ce quorum n’est pas atteint, une seconde convocation est effectuée et tous les membres présents délibèrent valablement sans tenir compte du quorum visé au présent article. Article 46: La résolution du Congrès du PDI portant sa dissolution est prise par les 4/5 de ses membres présents à la réunion du Congrès à laquelle participent au moins les ¾ de ses membres. Article 47: Délégations des pouvoirs Chaque organe du PDI peut temporairement déléguer ses pouvoirs à un autre organe du PDI qui lui est inférieur. L’acte de délégation des pouvoirs indique les pouvoirs délégués. Article  48: Collaboration avec d’autres formation politiques La décision du PDI de se coaliser avec une ou plusieurs formations politiques lors des élections ou à des fins de conquérir le pouvoir est prise par le Bureau Politique du PDI. La décision de fusionner le PDI avec une autre formation politique est prise par la réunion du Congrès dans les mêmes conditions que celles applicables à la dissolution du PDI. Article 49: Dissolution du PDI En cas de dissolution du PDI, ses biens et avoirs sont confiés à une autre formation politique ou à une organisation sans but lucratif déterminé par le Bureau Politique du PDI. Article 50: Pour les matières qui ne sont pas prévues par la Constitution de la République du Rwanda, par la Loi Organique régissant les formations politiques et les politiciens, par les présents Statuts et par le Règlement d’Ordre Intérieur du PDI, les décisions des organes du PDI restent applicables compte tenu de l’ordre hiérarchique de ces organes. Article 51: Entree en vigueur des présents Statuts Les présents Statuts entrent en vigueur le jour de leur approbation par l’organe de l’État compétent. Kigali, kuwa 11 Ugushyingo 2017 Sheikh HARERIMANA Mussa Fazil Perezida wa PDI STATUTES OF THE IDEAL DEMOCRATIC PARTY (PDI) FIRST REVISION OF 11/11/2017 OF THE STATUTES OF THE IDEAL DEMOCRATIC PARTY « PDI » PREAMBLE We, the signatories of the present Statutes, being fully mindful of the darkest moments that marked the history of Rwanda as a result of bad governance that culminated in the genocide against the Tutsi; Recognizing the need to promote and consolidate true democracy in our country for we strongly believe that there is no doubting the fact it is the pillar of justice, good governance and sustainable development; Pursuant to the Constitution of the Republic of Rwanda of 2003 revised in 2015, especially in Articles 52, 53 and 54; Pursuant to Organic Law no. 10/2013/OL of 11 July 2013 governing political organizations and politicians as amended to date; 
The Congress of the Ideal Democratic Party – PDI of 3 August 2013, after consideration of the Statutes of PDI and revision thereof in line with the provisions of Organic Law no. 10/2013/OL of 11 July 2013 governing political organizations and politicians, especially in articles 10, 12, 14, 17, 18, 23 and 55; 

ADOPT: CHAPTER ONE: CREATION OF A POLITICAL ORGANIZATION AND ITS SYMBOLS Section One: Name, mission, head office and seal Article one: Name There is hereby created for an indefinite period of time a political organization called “IDEAL DEMOCRATIC PARTY” -PDI hereinafter referred to as « PDI». 
 Article 2: Mission PDI mission is to always remain exemplary in terms of promoting democracy and the nation’s best interests, giving priority to equality, peace and development. Article 3: PDI Head Office PDI head office shall be located in the City of Kigali, the capital of the Republic of Rwanda. If necessary, it may be transferred to any other place on the territory of the Republic of Rwanda with the approval of the PDI Congress. Article 4: PDI emblems PDI emblems consists of a white rectangle, inside of which is nestled a green scale. The rectangle represents the all-out unity of Rwandans. The white represents peace which rests on civic education. The scale represents equal opportunities for all segments of the Rwandan population towards unhindered participation in all aspects of national life. The green symbolizes development centered on the role of population and national sovereignty. 
 Section 2 : Guiding Principles and major activities of PDI Article 5: Guiding principles Guiding Principles and major activities of PDI are the following: • All Rwandans enjoy equal rights in their country, making it necessary for each of them to love and sacrifice themselves for their country and look after its best interests and those of all Rwandans without any discrimination whatsoever; • All Rwandans are equal before the law. PDI is committed to educating all Rwandans to fight tirelessly any form of injustice and discrimination. PDI particularly undertakes to work assiduously to see the total eradication of genocide ideology in Rwanda, in the region and worldwide; • Power is a mandate received from God. Power is granted by the people by virtue of the Constitution of each country that prohibits any form of exclusion or restriction on the freedom of religion or belief and self-fulfillment or any other restriction contrary to internationally recognized human rights principles; • Economic and development policy must be people-oriented and contribute to increasing people’s wealth allowing thus avoiding anything that may give rise to exploding inequalities between rich and poor; • The living conditions of every Rwandan should constantly get improved. This being so, it is imperative to further the fight against ignorance and poverty whilst ensuring the equitable sharing of national wealth and avoiding greed, waste and bragging; • The progress of the Rwandan citizen in particular and that of the nation in general can only be acquired through his/her work and all the things that come with it; • Rwandan culture based on honor, integrity, courage, obedience to parents and adults, frankness and sincerity, mutual support towards conducting self-reliance activities, tolerance and humility and other positive values ​​must be developed and strengthened. Equally as important is the need to combat and eradicate bad practice of slavishly flattering, use of illicit drugs, drunkenness and prostitution that fuel the spread of endemic diseases; • Relations with foreign countries must be based on the norms and principles that govern international politics and be forged in a reasonable fashion while constantly working to promote the best interests of the nation and those all the Rwandan diaspora; • The gender perspective should serve as the mainstay of the national life, taking into account the need to create opportunities for women as a prerequisite to attaining this goal. Article 6: Major activities of PDI PDI is committed to carry out activities that are critical to staying true to its political commitments. The main activities are: • Explain to the public its political program; • Educate its members on its political ideology and the principal laws in force in the country especially those relating to the rights conferred upon them and their civic duties; • Equip its members with the ability to make a thoughtful analysis of what constitutes the best interests of the nation and those of PDI and ensure those interests; • Educate its members in particular and Rwandan citizens in general on the need to engage in democracy-oriented political activities; • Immensely contribute to the promotion of good governance and the search for solutions to the country's problems by means of a thorough analysis; • Perform any other activity not contrary to the law to publicize the Political Organization and its activities throughout the country. 
 CHAPTER II: MEMBERSHIP Section One: Members, duties and rights Article 7: PDI members With the exception of members who appended their signatures on these statutes on 05 July 2003, any other person who wishes to become PDI member shall do so in writing addressed to PDI President or any other person he/she has authorized in writing. Article 8: Membership requirements PDI member must be Rwandan national who is aged at least eighteen (18) years that has not been subject to deprivation of civil and political rights following a judicial decision. PDI member must specifically base his/her daily political activities on the provisions of article 5 hereof and be characterized mainly by the following: 
 • Comply with and implement national laws and PDI statutes as well as regulations which are not contrary to those laws and statutes; • Show courtesy and humility in his/her behavior and interpersonal relationships; • Demonstrate integrity and fight injustice and corruption; • Avoid practices of adulating, slavishly flattering, and rendering others totally dependent on him/her; • Tolerate and accept those whose opinions are different from his/her own; • Work assiduously and carry out self-development activities; • Engage in constant quest for knowledge in different areas, know information about the country in particular and the world in general; • Be aware of the activities of the country and those of PDI and participate therein; • Use words and actions to confront and combat discrimination in all its forms; • Avoid gossip and distinguishing him/herself in acts that are not important for or of interest to him/her; • Look after the interests of PDI in particular and those of its members in general. He/she must strive to lead an exemplary life. 
 Article 9: Rights of PDI members Each PDI member has the following rights: • Right to vote and stand as a candidate in PDI organs as provided by law; • Be informed of the activities of PDI in accordance with the Internal Rules and Regulations; • Enjoy a protection from PDI whenever it is obvious that he/she is a victim as a result of being a member of PDI. Section 2: Misconduct and exclusion Article 10: Form of misconduct The following are form of misconduct which shall be severely punished: • Acting contrary to the provisions of the present Statutes, Internal Rules and Regulations of PDI and other instructions issued by competent organs; • Dishonouring in public leaders of PDI; • Misappropriation of national or PDI property; • Failure to pay PDI contribution; • Failure to participate in PDI activities; • Being found guilty of serious criminal acts such as genocide and genocide ideology, discrimination, sectarianism and high treason. Section 3 : Organ in charge of Mediation and Conflict Resolution Article 11: Duties of the Organ There is hereby created an organ in charge of Mediation and Conflict Resolution responsible for: Reconciling and resolve disputes, examining conflicts between PDI members and provide interpretation of PDI Statutes and Internal Rules and Regulations. PDI Statutes shall provide for modalities by which a member suspected of misconduct is given opportunity to defend him/herself; the organ in which he/she can defend him/herself and punitive procedures. Any disciplinary action against a PDI member shall only be definitive after consideration thereof by the organ in charge of Mediation and Conflict Resolution. The Organ in charge of Mediation and Conflict Resolution shall comprise of two (2) levels: Primary level and appellate level. 
 Article 12: Members of the organ at the primary level Members of the organ in charge of Mediation and Conflict Resolution at the primary level shall be the following: • Two (2) youth representatives including at least one female member elected by their peers within the Political Bureau; • Two (2) representatives from a category other than youth category including at least one female member elected by their peers within the Political Bureau; • A wise person who has been a PDI member for at least five (5) years appointed by the Executive Committee. They shall elect from among themselves a member to serve as chairperson and rapporteur. Article 13: Members of the Appellate level Appellate level shall consist of all members of the Executive Committee with the exception of a member who may be involved in the matter before the Organ, in which case he/she is required to recuse him/herself. 
However, when all or a majority of Executive Committee members are involved in the matter before the Organ, the Political Bureau shall elect from among its three (3) eldest members to serve on Committee at the first level. Those elected members shall elect from among themselves a chairperson and a rapporteur. Article 14: Terminiation of membership The grounds for loss of membership are the following: • Irrevocable resignation from PDI; • Violation of the Statutes, regulations and decisions of PDI; • Membership in another political organization ; • Being found guilty through an unappealable court decision of an offense contrary to the conduct that served as the basis for admission to PDI; • Death. Irrevocable resignation from PDI shall be done in writing. Members of PDI Congress shall tender their resignation in writing addressed to PDI President. Such resignation shall be adopted by PDI Political Bureau. Members of other PDI organs shall tender their resignation in writing addressed to PDI leader at the Provincial level. CHAPTER III: PDI ORGANS AND THEIR OPERATION Section One : Congress Article 15: Inzego za PDI PDI organs are as follows: • The Congress; • the Political Bureau; • the Executive Committee; • the Provincial Organ. PDI Congress may put in place a decentralized PDI organs and determine modalities for the appointment of their leaders and determine their responsibilities. The head office of PDI Provincial organ shall be determined by PDI Congress.
 Article 16: Members of PDI Congress The Congress is the supreme PDI organ. It shall consist of the following one hundred fifty (150) members: • Twenty-five (25) members of the Congress of each Province and the City of Kigali; • Five (5) members of the Executive Committee; • Ten (10) members appointed by the Executive Committee because of their being in higher organs of the State, civil society and the private sector; • Ten (10) members appointed by the Political Bureau on the basis of their potential importance for PDI. Article 17: Responsibilities of Congress The Congress shall have the following responsibilities: • Adopt, complement and modify the guiding principles and statutes governing PDI; • Give the Political Organization orientation and strategies which shall be utilized to attain PDI objectives; • Elect and dismiss PDI Executive Committee members; • Prospective candidates for these posts must be members of PDI Political Bureau; • Decide if PDI shall participate in elections; determine posts to contest, candidates who shall contest those posts and campaign modalities. If PDI decides to contest elections in coalition with another Political Organization, provisions in this paragraph shall be based on mutual understanding between the leaders of the two political organizations; • Adopt the budget and annual activities report of PDI; • Take decisions on other problems in conformity with the provisions of these Statutes or the Internal Rules and Regulations; • Provide guidelines the Political Bureau shall base on in establishing PDI partnership and cooperation with other parties authorized to operate in the country or those in foreign countries with similar political ideology in the interest of the country and PDI; Article 18: Frencency of the meetings of the PDI Congress PDI Congress shall hold its ordinary meetings once a year. It may also be convened in extra ordinary meetings when necessary. Ordinary Congress meetings shall be convened and chaired by PDI President. In his/her absence they shall be convened by PDI First Vice President in charge of governance and justice. In his /her absence they shall be convened by the PDI Second Vice President in charge of economic affairs and development. The Congress extraordinary meetings may also be convened by PDI Secretary General for the following reasons: • If the President and the Vice Presidents refuse to convene the Congress extraordinary meeting and the date it was due exceeds six (6) months; • When it is evident that they shall not be available and the date on which the meeting is due is pending. When PDI Secretary General convenes a Congress meeting, it is he/she who chairs it except when the meeting was convened on request by PDI President or Vice President and is present during that meeting. If the meeting is convened by the PDI Secretary General and he/she chairs it; it shall elect from among members present a rapporteur. If the Party Secretary General cannot be available, the extraordinary ordinary meeting shall be convened and chaired by his/her Assistant and elect from among members present its rapporteur. An extraordinary meeting shall be convened and chaired by PDI Secretary General or his/her Assistant only when at least a fifth (1/5) of PDI Congress members so request. Such extraordinary meeting shall examine only urgent issues. Section 2: Political Bureau Article 19: Members of PDI Political Bureau The Political Bureau is composed of the following thirty-two (32) members: • Five (5) members of the Executive Committee; • The Coordinator of PDI in each Province and in the City of Kigali; • Two (2) members elected by the Congress of each Province and the City of Kigali; • The Coordinator of the Youth League and the Coordinator of the Women’s League; • Ten (10) members appointed by the Executive Committee on the basis of their potential importance for PDI. Former PDI Presidents and Vice Presidents shall also be members of the Political Bureau along with members referred to under paragraph One of this Article and continue to be members of PDI Political Bureau unless they personally choose to resign from the Political Bureau or PDI or the Congress disqualifies them due to any form of misconduct they showed in the course of the discharge of such duties. Article 20: Responsibilities of PDI Political Bureau The Political Bureau shall have the following responsibilities: • Prepare Congress meetings; • Implement Congress resolutions; • Give the Executive Committee guidelines on what should be done so that PDI can achieve its objectives. Such guidelines must not contradict with the existing laws or the political orientation of PDI; • Elect the coordinators of Permanent Commissions of the Political Bureau; • Expel from PDI any member in the Congress, in the Political Bureau or at District level if it becomes apparent that the District has failed to do so in spite of the request to do so by the Executive Committee on the basis of the Discipline Commission report; • Adopt the activities plan of the General Secretariat; • Perform such other duties as may be assigned by PDI Congress. Article 21: Frequency of Political Bureau meetings The Political Bureau shall hold an ordinary meeting every four (4) months, and shall be convened by PDI President. In his/her absence or when otherwise engaged, the Political Bureau shall be convened and chaired by the first Vice President of PDI in charge of governance and justice. In the latter’s absence or when otherwise engaged, the Bureau shall be convened and chaired by the Second Vice President in charge of Economic Affairs and Development. Should all of them be absent or otherwise engaged, the Bureau shall be convened and chaired by PDI Secretary General upon approval by a quarter (1/4) of the members of the Political Bureau. Should the Secretary General be absent or otherwise engaged, the Political Bureau shall be convened and chaired by PDI Deputy Secretary General upon approval by a quarter (1/4) of the members of the Political Bureau. Article 22: Standing Committees To better fulfill its mandate, the Political Bureau shall have the following standing committees: • The Committee on governance and justice; • The Economic and Planning Committee; • The Committee on Social Affairs and Gender. The responsibilities and functioning of the standing Committees shall be determined by the Rules of Procedure of PDI. Artcile 23: Responsibilities of Inspection Committee There is hereby established an Inspectorate of the Party consisting of an Inspector, a Deputy Inspector and a secretary. The Inspectorate shall have the following responsibilities: • Conduct the audit of the Party’s finance and property and provide advice on how best to produce the financial and property use report, prior to submission thereof to the relevant government bodies; • Supervise compliance with the regulations relating to the use of the Party’s finance and the property at all levels; • Provide guidance on how best to manage the Party’s property at all levels; • Perform such other duties as may be assigned by the Congress, the Political Bureau or the Executive Committee. The Congress may decide to increase the number of members of the Inspectorate. No Party’s property use report shall be sent to any relevant government organ without prior examination by the Party’s Inspectorate. In the discharge of its duties, the Inspectorate shall be independent and report to PDI President. PDI President may, after consultation with the Executive Committee, order the evaluation of the performance of the Inspectorate. PDI Rules of Procedure shall determine the functioning of the Inspectorate. Section 3: Executive Committee Article 24: PDI Executive Committee members PDI Executive Committee shall comprise of senior PDI leaders and its Secretaries General. PDI senior leaders are the President, First Vice President of PDI in charge of governance and justice and the Second Vice-President in charge of Economic Affairs and Development. The President shall be PDI legal representative while the First Vice President of PDI in charge of governance and justice and the Second Vice-President in charge of Economic Affairs and Development shall respectively serve as first deputy legal representative and second deputy legal representative of PDI. PDI Secretariat General shall comprise of the Secretary General, and the Deputy Secretary General. In the discharge of their duties, PDI Secretaries General shall be assisted by staff members appointed by the Executive Committee. Membership in the PDI Executive Committee shall be replaced by one of the representatives of Province / City of Kigali in the Congress and the Political Bureau. Loss of membership in PDI Executive Committee shall in no way entail the automatic loss of membership in PDI Political Bureau unless specified in the decision relating to such loss of membership. Membership in PDI Executive Committee shall be lost on any of the following grounds: • Act contrary to the provisions of PDI Statutes, and Rules of Procedure as well as other instructions issued by competent bodies; • Publicly bring the Party’s image into disrepute; • Publicly dishonor PDI leaders; • Missapropriate PDI property; • Fail to pay PDI contributions; • Fail to participate in PDI activities; • Be convicted of serious crimes such as the crime of genocide and genocide ideology, discrimination, divisionism, high treason and embezzlement of public property. • Be appointed to an office incompatible with membership in the Executive Committee. • Death. For any election to replace a member whose term of office expires, only candidacies from members of the Political Bureau shall be admitted. Article 25: Frenquency of Executive Committee meetings The Executive Committee shall hold an ordinary meeting once in every month. Also, it shall be convened and chaired by PDI President or, in his/her absence or when otherwise engaged, by the first Vice President in charge of Governance and Justice. Should both of them be absent or otherwise engaged, the Executive Committee shall be convened and chaired by the second Vice President in charge of Economic Affairs and Development. The Executive Committee shall prepare the meeting of the Political Bureau and the Congress, which shall bring together chairpersons of the Standing Committees, the Inspector and the chairperson of the Arbitration Committee. Decisions of the Extended Executive Committee shall be adopted only by members of the Executive Committee. Article 26: Responsibilites of the Executive Committee The Executive Committee shall have the following duties: • Give the Secretariat General instructions as to the implementation of the decisions of the higher organs of PDI; • Appoint and remove from office staff of PDI in accordance with the Internal Rules and Regulations; • Prepare the meeting of the Congress and that of the Political Bureau; • Supervise activities of the General Secretariat of PDI. Section 4: Duties of members of the Executive Committee Article 27: Duties of PDI President PDI President shall have the following duties: • Represent and serve as the spokesperson of PDI; • Convene and chair the meetings of Congress, those of the Political Bureau and those of the Executive Committee; • Monitor the implementation of the resolutions of Congress and those of the Political Bureau and the general line of PDI; • Table the annual report before Congress; • Submit activity reports to the General Secretariat which in turn submits to the Executive Committee, the Political Bureau and the Congress; • Provide guidance to the Secretariat as it relates to the analysis of documents sent to PDI and identification of the organs to which they are addressed. Article 28: Duties of the first Vice President in charge of Governance and Justice The first Vice President in charge of Governance and Justice shall have the following duties: • Assist PDI President and deputize for him/her in his/her absence or when otherwise engaged; • Conduct and analyze research on governance policies related to PDI political program; • Make follow-up on the implementation of the fundamental principles set out in Article 5 of the Party Statutes and PDI main activities; • Monitor relationships between PDI and other recognized political organizations in Rwanda; • Perform such other duties relevant to his/her office as may be assigned by the Party Congress, Political Bureau and the Executive Committee. Article 29: Duties of the second Vice President in charge of economic affairs and development The second Vice President in charge of economic affairs and development has the following attributions: • Assist PDI President and deputize for him/her should both PDI President and Vice President whose main one of main duties are to deputize for PDI President be absent or otherwise engaged; • Conduct and analyze research on economic policies and good management of public affairs in relation to PDI political program; • Make follow-up on PDI property management and development activities; • Make follow-up on the preparation, execution and management of PDI budget; • Perform such other duties relevant to his/her office as may be assigned to him/her by PDI Congress, Political Bureau and Executive Committee. Article 30: Duties of the PDI Secretary General PDI Secretary General shall have the following duties: 
 • Head the General Secretariat of PDI; • Submit the report of the General Secretariat of the Executive Committee; • Coordinate activities of the Standing Committees and those of the General Secretariat; • Prepare documents for the Congress, the Political Bureau and the Executive Committee; • Archive documents, audio recording media and other items recalling the history of the activities PDI; • Attend to issues of information and communication. Article 31: Duties of the Deputy Secretary General The Deputy Secretary General shall have the following duties: • Assist the Secretary General in the discharge of all his/her duties; • Deputize for the Secretary General in his/her absence. PDI General Secretariat shall be responsible for the daily operation of PDI. The organization and functioning of the General Secretariat shall be determined by the PDI Political Bureau. Section 5 : Provincial Congress : Article 32: Responsibilities of the Provincial Congress The Provincial Congress shall be responsible for the daily operation of PDI in the Province. It shall be specifically responsible for the following: • Elect the representatives of the Province within the Political Bureau; • Keep the register of PDI members at the Provincial or City of Kigali level; • Collect the contributions of PDI members at this level; • Perform such other duties as may be assigned by the Congress or the Political Bureau. The responsibilities of each member of the Provincial Bureau shall be provided under the Internal Rules and Regulations of PDI. 
 Article 33: PDI Provincial Congress members PDI Provincial Congress shall comprise of twenty (20) members from the Province concerned and elected by PDI members in the Province / City of Kigali. Such elections shall be conducted by the Executive Committee, which nominates a candidate for the post of Coordinator in each Province / City of Kigali to be approved by the Congress of each Province / City of Kigali. If the nominee is not approved, the Executive Committee shall nominate another candidate within a period not exceeding thirty (30) days. Article 34: Elections of PDI Provincial Congress members In collaboration with the Executive Committee, PDI Coordinator shall convene a meeting bringing together at least twenty (20) members of integrity and who regularly pay their contributions. Arrears of contributions shall entail the loss of the right to stand as a candidate. When the number of members present required participating in the election is more than twenty (20), but not exceeding forty (40), all members present shall be entitled to vote. When the number of members present is greater than forty (40), all the members present shall elect from among themselves forty (40) members having received the most votes who in turn shall elect from among themselves nineteen (19) members who shall make up the Provincial Congress along with the Provincial Coordinator. Modalities for the election shall be provided under the Internal Rules and Regulations of PDI. Article 35: Bureau at the Province / City of Kigali level members Members of the Provincial Congress shall elect from among themselves four (4) members, including a young person, a woman and two advisers. The elected members shall make up PDI Bureau at the Province / City of Kigali along with the Coordinator. The Bureau at the Province / City of Kigali level shall elect from among its members a Deputy Coordinator, a Secretary and two Advisers. 
 The Coordinator and the Secretary must be domiciled in the Province. CHAPTER IV: MEETINGS OF PDI ORGANS Article 36:PDI meetings Each PDI organ shall hold ordinary meetings. It may also hold extraordinary meetings. The Internal Rules and Regulations of PDI shall determine procedures for convening and chairing these meetings. Article 37: Subject to the provisions of articles 44, 45 and 46 hereof, the other PDI organs may meet only when at least ½ +1 of their members are present. If, after notice duly given, the quorum is not reached; a second notice shall be given within the two following weeks and members present shall validly deliberate regardless of the attendance quorum provided under this article. 
 Article 38: Decision- making process at PDI meetings Decisions of the meetings of PDI organs shall be taken by consensus of the members unless otherwise provided by the present Statutes. In the absence of consensus on any resolution, it shall be taken by an absolute majority of members present. Each PDI organ may invite to its meetings people who can help it better fulfill its responsibilities. CHAPTER V: PROPERTY Article 39: Sources of PDI assets The property of PDI shall come from the following sources: • Members’ contributions; • Donations and bequests; • Assets and income-generating activities of PDI; • State subsidies. PDI Congress shall determine modalities for the payment and collection of members’ contributions. Article 40: Management of PDI assets The Internal Rules and Regulations of PDI shall determine modalities for the management and disbursement of PDI resources sets the accounting standards to be followed by PDI organs and determine measures to be taken against those who are guilty of bad management of PDI resources. 
CHAPTER VI: TRANSITIONAL AND MISCELLANEOUS AND FINAL PROVISIONS Article 41: Continuation of duties for incumbent leaders of PDI As part of filling vacancies within the organs provided under the present PDI Statutes, the people in positions that are not removed shall continue to occupy their respective positions. Article 42: Term of office for members of PDI organs Members of PDI organs shall be elected for a term of five (5) years renewable.

 The term for PDI officials holding office on the date of the adoption of the present Statutes shall continue holding office and complete their term. 
PDI leadership shall be required to fill vacancies within the organs provided under the present Statutes within a period not exceeding six (6) months following its publication in the Official Gazette of the Republic of Rwanda.
 Article 43: PDI organ responsible for adopting its Internal Rules and Regulations The Internal Rules and Regulations adopted by PDI Congress shall explain in detail the present Statutes and define modalities for the application of their provisions. Article 44: Amendment of PDI Statutes The revision of PDI Statutes shall be decided by three-fourths (3/4) members of Congress present at the meeting examining the revision and must bring together at least two thirds (2/3) of members. If, after notice duly given, the quorum is not reached; a second notice shall be given and members present shall validly deliberate only when ½ + 1 members of Congress are present. Article 45: Amendment of PDI Internal Rules and Regulations The revision of PDI Internal Rules and Regulations shall be decided by two-thirds (2/3) of members of Congress present at the meeting examining the revision and must bring together at least 3/5 of the members. If, after notice duly given, the quorum is not reached; a second notice shall be given and all members present validly deliberate regardless of quorum provided under this article. 
Article 46: PDI Congress’s resolution dissolving PDI shall be made by four fifths (4/5) of its members present at the meeting of the Congress bringing together at least three quarters (3/4) of its members. Article 47: Delegation of powers Each PDI organ may temporarily delegate its powers to another lower PDI organ. The instrument of delegation shall indicate the delegated powers. 
 Article  48: Collaborative relations with other political organizations PDI's decision to enter coalition with one or several political organizations for elections or for the conquest of power shall be taken by PDI Political Bureau.
 The decision to merge PDI with another political organization shall be taken by the meeting of the Congress in the same conditions as those applicable to the dissolution of PDI. Article 49: Dissolution of PDI In case of dissolution of PDI, its property and assets shall devolve upon another political organization or a non-profit organization determined by PDI Political Bureau. Article 50: Matters not provided in the Constitution of the Republic of Rwanda, Organic Law governing political organizations and politicians, by the present Statutes and the Internal Rules and Regulations of PDI, decisions of PDI organs shall apply taking into account the hierarchy of these organs. Article 51: Entry into force of the present statutes The present Statutes shall come into force on the date of their approval by the competent State organ. Kigali, on 11 November 2017 Sheikh HARERIMANA Mussa Fazil PDI President STATUTS DU PARTI DÉMOCRATE IDÉAL (PDI) PREMIERE REVISION DU 11/11/2017 DES STATUTS DU PARTI DÉMOCRATE IDÉAL « PDI » PRÉAMBULE Nous, signataires des présents Statuts, tenant pleinement compte des moments sombres qui ont jalonné l’histoire du Rwanda à cause de la mauvaise gouvernance qui a culminé avec le génocide perpétré contre les Tutsi ; Conscients de la nécessité de promouvoir et de consolider la vraie démocratie dans notre pays car nous sommes convaincus qu’elle est le pilier incontestable de la justice, de la bonne gouvernance et du développement durable ; Vu la Constitution de la République du Rwanda de 2003 révisée en 2015, spécialement en ses articles 52, 53 et 54; Vu la Loi Organique n° 10/2013/OL du 11 juillet 2013 portant organisation des formations politiques et des politiciens comme modifié jusqu’à ce jour; Le Congrès du Parti Démocrate Idéal-PDI du 3 août 2013, après l’examen des Statuts du PDI et leur adaptation aux dispositions de la Loi Organique no. 10/2013/OL du 11 juillet 2013 portant organisation des formations politiques et les politiciens, spécialement en ses articles 10, 12, 14, 17, 18, 23 et 55 ; ADOPTONS: CHAPITRE PREMIER: CRÉATION D’UNE FORMATION POLITIQUE ET SES SYMBOLES Section première: Dénomination, mission, siège et sceau Article premier: Dénomination Il est créé pour une durée indéterminée une formation politique dénommée « PARTI DÉMOCRATE IDÉAL » -PDI ci-après dénommée « PDI». Article 2: Mission La mission du PDI consiste à être toujours exemplaire dans la promotion de la démocratie et des intérêts supérieurs de la nation, la priorité étant accordée à l’égalité, à la paix et au développement. Article 3: Siège du PDI Le siège du PDI est établi dans la Ville de Kigali, Capitale de la République du Rwanda. Il peut, en cas de nécessité, être transféré en tout autre lieu du territoire de la République du Rwanda sur approbation du Congrès du PDI. Article 4: Armoires du PDI L’emblème du PDI se compose d’un rectangle blanc à l’intérieur duquel se trouve une balance verte. Le rectangle symbolise l’unité tous azimuts des Rwandais. La couleur blanche symbolise une paix fondée sur l’éducation civique; La balance symbolise l’égalité des chances entre toutes les couches de la population rwandaise quant à la pleine participation à tous les aspects de la vie nationale. La couleur verte symbolise le développement axé sur le rôle de la population et la souveraineté nationale. Section 2 : Principes directeurs et principales activités du PDI Article 5: Principes directeurs Les principes directeurs et les principales activités politiques du PDI sont les suivants: • Tous les Rwandais jouissent des mêmes droits dans leur pays et ceci oblige chacun d’entre eux à l’amour de la patrie et à se sacrifier pour elle et à veiller à ses intérêts supérieurs et à ceux de tous les Rwandais sans discrimination aucune ; • Tous les Rwandais sont égaux devant la loi. PDI s’engage à sensibiliser tous les Rwandais à combattre sans faiblir toute forme d’injustice et de discrimination. PDI s’engage tout particulièrement à travailler à l’éradication totale de l’idéologie du génocide au Rwanda, dans la région et dans le monde entier ; • Le pouvoir est un mandat reçu de Dieu. C’est le peuple qui donne le pouvoir en vertu des dispositions de la Constitution de chaque pays qui ne tolère aucune exclusion ou restriction de la liberté de foi et de l’épanouissement individuel ou toute autre restriction contraire aux principes relatifs aux droits fondamentaux de la personne universellement reconnus ; • La politique économique et de développement doit être axée sur la population et contribuer à l’enrichissement de celle-ci tout en permettant ainsi d’éviter tout ce qui peut occasionner des inégalités criardes entre les riches et les pauvres ; • Les conditions de vie de chaque Rwandais doivent toujours s’améliorer. Cela étant, il est impératif de s’atteler à la lutte contre l’ignorance et la pauvreté en veillant au partage équitable de la richesse nationale et en évitant l’avidité, le gaspillage et la vantardise ; • Les progrès du citoyen rwandais en particulier et ceux de la nation en général ne peuvent être acquis que par son travail et tout ce qui l’accompagne ; • La culture rwandaise fondée sur l’honneur, l’intégrité, la bravoure, l’obéissance aux parents et aux adultes, la franchise et la sincérité, le soutien mutuel dans les activités d’auto-développement, la tolérance et humilité ainsi que d’autres valeurs positives doivent être développées et renforcées. Il importe également de combattre et d’éradiquer la mauvaise pratique de faire de la lèche, d’usage de drogues illicites, l’ivrognerie et la prostitution qui favorisent la propagation des maladies endémiques ; • Les relations avec les pays étrangers doivent se fonder sur les principes et les normes de la politique internationale et se tisser de manière raisonnable tout en veillant toujours à promouvoir les intérêts supérieurs de la nation et de toute la diaspora rwandaise ; • La perspective sexospécifique doit servir de pilier principal de la vie nationale en tenant compte des chances à donner aux femmes en vue d’atteindre ce but. Article 6: Principales activités du PDI PDI est engagé à réaliser les activités lui permettant d’accomplir ses engagements politiques. Les principales activités sont les suivantes : • Expliquer à la population son programme politique; • Éduquer ses membres sur l’idéologie politique et sur les principales lois en vigueur dans le pays surtout celles relatives aux droits qui leur sont reconnus ainsi que sur leurs devoirs en tant que citoyens; • Inculquer à ses membres des capacités à faire une analyse judicieuse de ce qui constitue les intérêts supérieurs de la nation et du PDI et à veiller à ces intérêts ; • Éduquer ses membres en particulier et les citoyens rwandais en général sur la nécessité de mener des activités politiques axées sur la démocratie ; • Contribuer considérablement à la promotion de la bonne gouvernance et à la recherche des solutions aux problèmes du pays à l’aide d’une analyse approfondie ; • Réaliser toute autre activité non contraire à la loi visant à faire connaître la formation politique et ses activités dans le pays. CHAPITRE II: MEMBRES DU PDI Section première: Membres, devoirs et droits Article 7: Membres du PDI À l’exception des personnes ayant apposé leurs signatures aux présents Statuts en date du 05/07/2003, toute autre personne qui désire être membre du PDI doit adresser leur demande écrite au Président du PDI ou à toute autre personne munie du mandat écrit du Président. Article 8: Conditions d’adhésion Un membre du PDI doit être de nationalité rwandaise et âgé d’au moins dix-huit (18) ans qui n’a pas fait l’objet de déchéance des droits civils et politiques par décision judiciaire. Un membre du PDI doit particulièrement baser ses activités politiques quotidiennes sur les dispositions de l’article 5 des présents Statuts et se caractériser principalement de ce qui suit : • Respecter et appliquer les lois du pays et les statuts du PDI ainsi que les règlements non contraires à ces lois et statuts ; • Faire preuve de politesse et d’humilité dans ses comportements et dans ses relations interpersonnelles ; • Faire preuve d’intégrité et combattre l’injustice et la corruption ; • Éviter les pratiques de faire de la lèche, flatter servillement et soumettre autrui à la dépendance; • Tolérer et accepter les opinions différentes des siennes; • Faire preuve de travail assidû et s’atteler aux activités d’auto-développement; • Être toujours en quête de connaissances dans différents domaines, connaître des informations concernant le pays en particulier et le monde en général ; • Suivre les activités du pays et celles du PDI et y participer; • User des paroles et des actes pour affronter et combattre la discrimination sous toutes ses formes ; • Éviter des commérages et de se faire remarquer dans les actes qui ne présentent pas une importance ou un intérêt pour lui ; • Veiller aux intérêts du PDI en particulier et de ses membres en général. Il doit s’évertuer à mener une vie exemplaire. Article 9: Droits du membre du PDI Chaque membre du PDI jouit des droits suivants: • Droit de vote et d’éligibilité au sein des organes du PDI dans les conditions prévues par la loi; • Être informé des activités du PDI dans les conditions prévues par le Règlement d’Ordre Intérieur; • Jouir d’une protection du PDI chaque fois qu’il est évident qu’il est victime à la suite de son adhésion au PDI. Section 2: Fautes et exclusion Article 10: Les fautes Les fautes qui sont sévèrement punies sont les suivantes : • Agir en contravention des dispositions des présents statuts, de celles du Règlement d’ordre intérieur du PDI et d’autres instructions édictées par les organes compétents ; • Déshonorer publiquement les responsables du PDI; • Détourner le patrimoine du Pays ou celui du PDI; • Ne pas s’acquitter de la cotisation du PDI; • Ne pas participer aux activités du PDI; • Être reconnu coupable des actes criminels graves tels que le crime de génocide et d’idéologie du génocide, le crime de discrimination, de divisionnisme et de haute trahison. Section 3 : Organe chargé de la médiation et la résolution des conflits Article 11: Devoirs d’ un Organe Il est créé un Organe chargé de la médiation et la résolution des conflits chargé de: Concilier et régler les litiges, examiner les conflits entre les membres du PDI et assurer l’interprétation des Statuts et règlements du PDI. Les Statuts du PDI prévoient les modalités de défense du membre poursuivi pour faute, l’organe de recours ainsi que les modalités de punition. Toute sanction prise à l’encontre d’un membre du PDI ne peut être définitive qu’après son examen par lo’rgane chargé de la médiation et la résolution des conflits. L’Organe chargé de la médiation et la résolution des conflits comprend deux (2) instances: Première instance et instance de recours. Article 12: Membres de l‘organe en première instance Les membres de l‘organe chargé de la médiation et la résolution des conflits en première instance sont les suivants: • Deux (2) représentants de la jeunesse dont au moins un membre de sexe féminin élus par leurs pairs au sein du Bureau Politique; • Deux (2) représentants relevant d’une catégorie autre que celle de la jeunesse dont au moins un membre de sexe féminin élus par leurs pairs au sein du Bureau Politique; • Une personne sage qui est déjà membre du PDI pour au moins cinq (5) ans nommé par le comité Exécutif. Ils élisent en leur sein un président et un rapporteur. Article 13: Membres de l’instance de recours L’instance de recours est constituée de tous les membres du Comité Exécutif à l’exception d’un membre qui serait visé par la question dont est saisi le Comité, auquel cas il lui est enjoint de se retirer. Toutefois, lorsque l’ensemble ou la majorité des membres du Comité Exécutif sont visés par la question dont est saisi le Comité, le Bureau Politique élit en son sein ses trois (3) membres les plus âgés pour siéger au Comité en première instance. Les membres élus élisent en leur sein un président et un rapporteur. Article 14: Cessation d’adhésion La cessation d’adhésion d’un membre intervient dans les cas suivants : • Démission définitive du PDI; • Violation des lois et des décisions du PDI; • Adhésion à une autre formation politique; • Être reconnu coupable par décision judiciaire devenue définitive d’une infraction contraire à la bonne conduite qui a servi de base pour son admission au PDI; • Décès. La démission définitive du PDI est faite par écrit. Les membres du Congrès du PDI démissionnent par écrit adressé au Président du PDI et leur démission est adoptée par les membres du Bureau Politique du PDI. Les membres des autres organes du PDI démissionnent par écrit adressé aux dirigeants du PDI au niveau de la Province. CHAPITRE III: ORGANES DU PDI ET LEUR FONCTIONNEMENT Section première: Congrès Article 15: Organes du PDI Les organes du PDI sont les suivants: • le Congrès ; • le Bureau Politique ; • le Comité Exécutif ; • l’Organe de Province. Le Congrès du PDI peut mettre en place les organes de base du PDI et déterminer les modalités de nomination de leurs responsables et définir leurs attributions. Le siège de l’organe de Province du PDI est déterminé par le Congrès du PDI. Article 16: Membres du Congrès du PDI Le Congrès est l’organe suprême du PDI. Il est composé de cent cinquante (150) membres suivants : • Vingt-cinq (25) membres du Congrès de chaque Province et de la Ville de Kigali; • Cinq (5) membres du Comité Exécutif; • Dix (10) membres nommés par le Comité Exécutif parce qu’ils sont dans les organes supérieurs de l’État, de la société civile ou du secteur privé ; • Dix (10) membres nommés par le Bureau Politique sur base de l’importance éventuelle pour le PDI. Article 17: Attributions du congrès Le congrès est chargé de ce qui suit: • Adopter, compléter et modifier les principes directeurs et les statuts du PDI; • Donner l’orientation politique et les stratégies à suivre pour atteindre les objectifs du PDI; • Elire et révoquer le Comité Exécutif du PDI ; • Les candidats à ces postes doivent être parmi les membres du Bureau Politique du PDI ; • Décider de la participation du PDI aux élections, des postes à briguer, des candidats à proposer à ces postes et les modalités de la campagne. Lorsque PDI décide de coaliser avec une autre formation politique lors des élections, les dispositions de la présente phrase se basent sur la convention entre les dirigeants de deux formations politique ; • Adopter le budget et le rapport annuel d’activités du PDI ; • Prendre des décisions sur d’autres questions en conformité avec les dispositions des présents statuts ou du Règlement d’ordre intérieur ; • Donner la ligne directrice du Bureau Politique dans le partenariat et la coopération du PDI et les autres formations politiques agréés au Rwanda ou ceux des pays étrangers de même idéologie politique dans le but d’intérêt du Pays et celui du PDI; Article 18: Fréquence des réunions du Congrès du PDI Le Congrès du PDI tient ses réunions ordinaires une fois par an, et il est également convoqué en réunions extraordinaires chaque fois que de besoin. Les réunions ordinaires du Congrès sont convoquées et dirigées par le Président du PDI. Lorsqu’il est absent ou empêché, elles sont convoquées et dirigées par le premiere Vice-président du PDI en charge de la gouvernance et de la justice. Lorsqu’il est absent ou empêché, elles sont convoquées et dirigées par le deuxième Vice-Président chargé des affaires économiques et du développement. Les réunions extraordinaires du Congrès peuvent également être convoquées par le Secrétaire Général du PDI pour des raisons suivantes : • Lorsque le Président et les Vice-Présidents ont refusé de convoquer la réunion ordinaire du Congrès et que sa date est dépassée de six (6) mois ; • Lorsque leur empêchement est évident alors que le retard s’affiche. Lorsque le Secrétaire Général du PDI convoque la Congrès, c’est lui-même qui la dirige, sauf lorsqu’il l’a convoqué sur demande du Président ou du Vice-Président du PDI et lorsqu’ils sont présents à la réunion. Lorsqu’elle est convoquée et dirigée par le Secrétaire Général du PDI, la réunion élit en son sein un rapporteur. Lorsque le Secrétaire Général est à son tour empêché, la réunion extraordinaire est convoqué est dirigée par le Secrétaire Général Adjoint et élit en son sein un rapporteur. La réunion extraordinaire est convoquée et dirigée par le Secrétaire Général ou par son Adjoint, à la demande d’un 1/5 au moins des membres du Congrès du PDI. Ladite réunion extraordinaire de traite que les points urgents. Section 2: Bureau Politique Article 19: Membres du Bureau Politique du PDI Le Bureau Politique est composé de trente-deux (32) membres suivants: • Cinq (5) membres du Comité Exécutif; • Le coordinateur du PDI dans chaque Province et dans la Ville de Kigali; • Deux (2) membres élus par le congrès de chaque Province et de la Ville de Kigali; • Le Coordinateur de la ligue des jeunes et le coordinateur de la ligue des femmes; • Dix (10) membres nommés par le Comité Exécutif sur base de leur importance éventuelle pour le PDI. Les anciens Présidents et Vice-Présidents du PDI s’ajoutent aux membres visés à l’alinéa premier du présent article et continuent d’être membres du Bureau Politique du PDI à moins qu’ils demandent eux-mêmes de démissionner du Bureau Politique ou du PDI ou que le Congrès invalide leur éligibilité au Bureau Politique à cause d’une méconduite qu’ils ont affichée dans l’exercice de ces fonctions. Article 20: Attributions du Bureau Politique du PDI Le Bureau Politique a les attributions suivantes: • Préparer la réunion du Congrès ; • Assurer le respect des résolutions de la réunion du Congrès ; • Donner au Comité Exécutif la ligne directrice des activités à mener pour atteindre les objectifs du PDI. Ladite ligne ne doit pas être contraire à la loi et à l’orientation politique du PDI; • Elire les coordinateurs des Commissions Permanentes du Bureau Politique ; • Démettre du PDI le membre du Congrès, celui du Bureau Politique et celui du niveau du District lorsque ce dernier ne peut pas le démettre alors qu’il lui est demandé par le Comité Exécutif sur base du rapport de la Commission de Discipline ; • Adopter le plan d’activités du Secrétariat Général ; • Toute autre tâche qui lui serait assigné par le Congrès du PDI. Article 21: Fréquence des réunions du Bureau Politique Le Bureau Politique se réunit une fois par quatre (4) mois en réunions ordinaires sur convocation du Président du PDI. En cas d’absence ou d’empêchement de ce dernier, le Bureau Politique est convoqué et présidé par le premier Vice-Président du PDI en charge de la gouvernance et de la justice. En cas de son absence ou de son empêchement, la réunion est convoquée et présidée par le deuxième Vice-Président chargé des affaire économiques et du développement. En cas de leur absence ou d’empêchement simultanés, le Bureau est convoqué et dirigé par le Secrétaire Général du PDI sur approbation d’un quart (1/4) des membres du Bureau Politique. Lorsque lui-même est absent ou empêché, le Bureau est convoqué et présidé par le Secrétaire Général Adjoint du PDI sur approbation d’un quart (1/4) des membres du Bureau Politique. Article 22: Commissions permanentes Pour mieux remplir ses attributions, le Bureau Politique est doté des Commissions permanentes suivantes: • Commission de la gouvernance et de la justice; • Commission Économique et de Planification; • Commission sociale et de gender. Les attributions et le fonctionnement des Commissions permanentes sont déterminés par le Règlement d’Ordre Intérieur du PDI. Article 23 : Attribution du Comité d’Inspection Il est créé un Comité d’Inspection du Parti composé d’un Inspecteur, d’un Inspecteur adjoint et d’un Secrétaire. Le Comité d’Inspection a les attributions suivantes: • Faire l’audit des finances et du patrimoine du parti et donner des conseils sur la meilleure production du rapport financier et du patrimoine avant qu’il ne soit soumis aux organes compétents de l’État; • Contrôler le respect des règlements relatifs à l’utilisation des finances et du patrimoine du Parti à tous les échelons; • Donner des conseils sur la meilleure gestion du patrimoine du Parti à tous ses échelons; • Accomplir toute autre tâche assignée par le Congrès, le Bureau Politique ou le Comité Exécutif. Le Congrès peut décider de l’augmentation du nombre de membres du Comité d’Inspection. Aucun rapport sur l’utilisation du patrimoine du Parti ne peut être envoyé à un quelconque organe compétent de l’État sans examen préalable par le Comité d’Inspection du Parti. Le Comité d’Inspection est indépendant dans l’exercice de ses attributions et fait rapport au Président du Parti. Après consultation du Comité Exécutif, le Président du Parti peut ordonner l’audit de la performance du Comité d’Inspection. Le Règlement d’Odre Intérieur du PDI détermine le fonctionnement du Comité d’Inspection. Section 3: Comité Exécutif Article 24: Membres du Comité Exécutif du PDI Le Comité Exécutif du PDI est composé des Dirigeants Supérieurs du PDI et ses Secrétaires Généraux. Les Dirigeants Supérieurs du PDI sont : le Président, le premier Vice-Président en charge de la gouvernance et de la justice et le deuxième Vice-Président chargé des affaires économiques et du développement. Le Président est le Représentant Légal ; le premier Vice-Président en charge de la gouvernance et de la justice est le Premier Représentant Légal Suppléant. Le deuxième Vice-Président chargé des affaires économiques et du développement est le deuxième Représentant Légal Suppléant du PDI. Le Secrétariat Général du PDI est composé du Secrétaire Général et du Secrétaire Général Adjoint. Dans leurs fonctions, les Secrétaires Généraux du PDI sont assistés par le personnel du PDI nommé par le Comité Exécutif. La qualité de membre du Comité Exécutif est remplacé par l’un des représentants de Province/Ville de Kigali au Congrès et au Bureau Politique. La perte de qualité de membre du Comité Exécutif du PDI n’entraîne pas d’office la perte de qualité de membre du Bureau Politique du PDI à moins que cela ne soit précisé dans la décision portant perte de cette qualité de membre. La qualité de membre du Comité Exécutif du PDI se perd dans les cas suivants: • Agir contrairement aux dispositions des Statuts, de celles du Règlement d’ordre intérieur du PDI et d’autres instructions édictées par les organes compétents ; • Ternir l’image du Parti dans le public ; • Déshonorer publiquement les responsables du PDI; • Détourner le patrimoine du PDI; • Ne pas s’acquitter de la cotisation du PDI; • Ne pas participer aux activités du PDI; • Être reconnu coupable des actes criminels graves tels que le crime de génocide et d’idéologie du génocide, le crime de discrimination, de divisionnisme, de haute trahison et de détournement des biens publics ; • Être nommé à des fonctions incompatibles avec la qualité de membre du Comité Exécutif. • Décès. Lors de l’élection de remplacement d’un membre dont le mandat vient à expiration, seules les candidatures des membres du Bureau Politique sont admises. Article 25: Fréquence des réunions du Comité Exécutif Le Comité Exécutif se réunit une fois par mois en réunions ordinaires. Il est en outre convoqué et présidé par le Président du PDI. En cas d’absence ou d’empêchement de ce dernier, il est convoqué et présidé par le premier Vice-Président en charge de la gouvernance et de la justice et par le deuxième Vice-Président chargé des affaires économiques et du développement en cas de son absence ou de son empêchement. Le Comité Exécutif prépare la réunion du Bureau Politique et du Congrès regrouoant les présidents des commissions permanentes, l’Inspecteur et le Président du Comité d’Arbitrage. Les décisions du Comité Exécutif élargi sont adoptées par les seuls membres du Comité Exécutif. Article 26: Attributions du Comité Exécutif Le Comité Exécutif a les attributions suivantes: • Donner au Secrétariat Général les instructions lui permettant de mettre en application les décisions des organes supérieurs du PDI; • Nommer et révoquer le personnel du PDI dans les conditions prévues par le Règlement d’Ordre Intérieur; • Préparer la réunion du Congrès et celle du Bureau Politique; • Superviser les activités du Secrétariat Général du PDI. Section 4: Attributions des membres du Comité Exécutif Article 27: Attributions du Président du PDI Le Président du PDI a les attributions suivantes: • Etre le représentant et le porte-parole du PDI; • Convoquer et diriger les réunions du Congrès, celles du Bureau Politique et celles du Comité Exécutif ; • Suivre de près la mise en application des résolutions du Congrès et de celles du Bureau Politique et de la ligne générale du PDI; • Présenter le rapport annuel au Congrès; • Soumettre le rapport d’activités au Secrétariat Général pour que celui-ci le soumet à son tour au Comité Exécutif, au Bureau Politique et au Congrès; • Donner au Secrétariat Général des orientations concernant l’analyse des documents envoyés au PDI et déterminer les organes auxquels ils sont destinés. Article 28: Attributions du Vice-Président en charge de la gouvernance et de la justice Le premier Vice-Président en charge de la gouvernance et de la justice a les attributions suivantes: • Assister le Président du PDI et le remplacer en cas d’absence ou d’empêchement; • Réaliser et analyser les recherches sur les politiques de gouvernance en rapport avec le programme politique du PDI; • Faire le suivi de la mise en oeuvre des principes fondamentaux prévus à l’article 5 des Statuts du Parti et des activités principales du PDI; • Faire le suivi des relations entre le PDI et d’autres formations politiques reconnues au Rwanda; • Accomplir toute autre tâche relevant de ses fonctions que le Congrès, le Bureau Politique et le Comité Exécutif du Parti pourraient lui assigner. Article 29: Attributions du deuxième Vice-Président en charge des affaires économiques et du développement Le deuxième Vice-Président en charge des affaires économiques et du développement a les attributions suivantes : • Assister le Président du PDI et le remplaçer en cas d’absence ou d’empêchement simultanés de ce dernier et du Vice-Président dont l’une des attributions principales consiste à remplacer le Président du PDI; • Réaliser et analyser des recherches sur les politique économiques et de bonne gestion de la chose publique en rapport avec le programme politique du PDI; • Faire le suivi des activités de gestion du patrimoine et de développement du Parti; • Faire le suivi de la préparation, de l’exécution et de la gestion du budget du PDI; • Accomplir toute autre tâche relevant de ses fonctions que le Congrès, le Bureau Politique et le Comité Exécutif du Parti pourrraient lui assigner. Article 30: Attributions du Secrétaire Général du PDI Le Secrétaire Général du PDI a les attributions suivantes: • Diriger le Secrétariat Général du Parti; • Présenter le rapport du Secrétariat Général au Comité Exécutif; • Coordonner les activités des Commissions permanentes et celles du Secrétariat Général ; • Élaborer les documents destinés au Congrès, au Bureau Politique et au Comité Exécutif ; • Archiver les documents, les supports audio et d’autres éléments retraçant l’histoire des activités du PDI; • S’occuper des questions d’informations et de communication. Article 31: Attributions du Secrétaire Général Adjoint Le Secrétaire Général Adjoint a les attributions suivantes: • Assister le Secrétaire Général dans l’exercice de toutes ses fonctions; • Assurer l’intérim du Secrétaire Général en cas d’absence. Le Secrétariat Général du PDI assure le fonctionnement quotidien du PDI. L’organisation et le fonctionnement du Secrétariat Général sont déterminés par le Bureau Politique du PDI. Section 5 : Congrès provincial: Article 32: Attributions du Congrès provincial Le Congrès provincial est chargé d’assurer le fonctionnement quotidien du PDI au niveau de la Province. Il est particulièrement chargé de ce qui suit : • Élire les représentants de la Province au sein du Bureau Politique; • Tenir le registre des membres du PDI au niveau de la Province ou de la Ville de Kigali ; • Collecter les cotisations des membres du PDI à ce niveau ; • Exécuter toute autre tâche qui lui serait assigné par le Congrès ou le Bureau Politique. Les attributions de chacun des membres du Bureau Provincial sont prévues au Règlement d’Ordre Intérieur du PDI. Article 33: Membres du Congrès Provincial du PDI Le Congrès Provincial du PDI est composé de vingt (20) membres issus de la Province concernée et élus par les membres du PDI dans cette Province/Ville de Kigali. Ces élections sont dirigées par le Comité Exécutif qui propose un candidat au poste de Coordinateur au niveau de chaque Province/Ville de Kigali qui doit être approuvé par le Congrès de chaque Province/Ville de Kigali. Lorsque le candidat proposé n’est pas approuvé, le Comité Exécutif propose un autre candidat dans un délai ne dépassant pas trente (30) jours. Article 34: Elections de membres du Congrès Provincial. En collaboration avec le Comité Exécutif, le Coordinateur du PDI convoque une réunion à laquelle prennent part au moins vingt (20) membres intègres et qui s’acquittent de leur cotisation. Les arriérés de cotisation emportent la perte du droit d’éligibilité. Lorsque le nombre de membres présents devant participer à l’élection est supérieur à vingt (20) mais et ne dépasse pas quarante (40), tous les membres présents sont autorisés à voter. Lorsque le nombre de membres présents est supérieur à quarante (40), tous les membres présents élisent en leur sein quarante (40) membres qui ont eu le plus de voix qui, à leur tour, élisent en leur sein dix-neuf (19) membres qui s’ajoutent au Coordinateur pour constituer le Congrès Provincial. Les modalités de vote sont déterminées par le Règlement d’Ordre Intérieur du PDI. Article 35: Membres du Bureau au niveau de la Province/Ville de Kigali Les membres du Congrès Provincial élisent en leur sein quatre (4) membres dont une personne jeune, une femme et deux conseillers. Les membres élus s’ajoutent au Coordinateur pour constituer le Bureau du PDI au niveau de la Province/Ville de Kigali. Le Bureau au niveau de la Province/Ville de Kigali élit en son sein un Coordinateur Adjoint, un Secrétaire et deux Conseillers. Le Coordinateur et le Secrétaire doivent être domiciliés dans cette Province. CHAPITRE IV: RÉUNIONS DES ORGANES DU PDI Article 36: Réunions du PDI Chaque organe du PDI tient des réunions ordinaires. Il peut également tenir des réunions extraordinaires. Le Règlement d’Ordre Intérieur du PDI détermine les modalités de convocation et de direction de ces réunions. Article 37: Sous réserve des dispositions des articles 44, 45 et 46 des présents Statuts, les autres organes du PDI ne peuvent se réunir que lorsqu’au moins ½ +1 de leurs membres sont présents. Si, après une convocation régulièrement faite, ce quorum n’est pas atteint, une seconde convocation est effectuée dans les deux semaines qui suivent et les membres présents délibèrent valablement sans tenir compte du quorum visé au présent article. Article 38: Modalites de prises des décisions des réunions Les décisions des réunions des organes du PDI sont prises par consensus des membres à moins que les présents Statuts n’en disposent autrement. À défaut de consensus sur une quelconque résolution, celle-ci est prise à la majorité absolue des membres présents. Chaque organe du PDI peut inviter à ses réunions les personnes qui peuvent l’aider à mieux remplir ses attributions. CHAPITRE V: PATRIMOINE Article 39: Sources du patrimoine du PDI Le patrimoine du PDI provient des sources suivantes : • Cotisations des membres ; • Dons et legs; • Biens et activités génératrices de revenus du PDI; • Subventions de l’État. Le Congrès du PDI détermine les modalités de paiement et de collecte des cotisations des membres. Article 40: Gestion du patrimoine du PDI Le Règlement d’Ordre Intérieur du PDI détermine les modalités de gestion et de décaissement des ressources du PDI, fixe les normes comptables devant être suivies par les organes du PDI, les mesures prises à l’encontre de ceux qui se rendent coupables de la mauvaise gestion des ressources du PDI. CHAPITRE VI: DISPOSITIONS TRANSITOIRES, DIVERSES ET FINALES Article 41: Poursuite de l’exercice de leurs fonctions par les dirigents actuels du PDI Dans le cadre de pourvoir aux postes vacants au sein des organes prévus par les présents Statuts du PDI, les personnes occupant les postes qui ne sont pas supprimés restent maintenus à leurs postes respectifs. Article 42: Mandat des membres des organes du PDI Les membres des organes du PDI sont élus pour un mandat de cinq (5) ans renouvelable. Le mandat des responsables du PDI qui sont en fonction lors de l’adoption des présents Statuts continuent d’assumer leurs fonctions et terminer leur mandat. La direction du PDI est tenue de pourvoir aux postes vacants au sein des organes prévus par les présents Statuts dans un délai ne dépassant pas six (6) mois suivant sa publication au Journal Officiel de la République du Rwanda. Article 43: Organe du PDI chargee du adoption du Règlement d’Ordre Intérieur Le Règlement d’Ordre Intérieur du PDI adopté par le Congrès du PDI explique en détails les présents Statuts et définit les modalités d’application de leurs dispositions. Article 44: Modification des Statuts du PDI La révision des Statuts du PDI est décidée par les trois quarts (3/4) des membres du Congrès présents dans la réunion statutant sur cette révision et qui doit réunir au moins les deux tiers (2/3) des membres. Lorsque ce quorum n’est pas atteint, une seconde convocation est effectuée et la réunion ne peut délibérer valablement que lorsque les ½ + 1 des membres du Congrès sont présents. Article 45: Modification du Règlement d’Ordre Intérieur du PDI La révision du Règlement d’Ordre Intérieur du PDI est décidée par les deux tiers (2/3) des membres du Congrès présents dans la réunion statuant sur cette révision et qui doit réunir au moins les 3/5 des membres. Lorsque ce quorum n’est pas atteint, une seconde convocation est effectuée et tous les membres présents délibèrent valablement sans tenir compte du quorum visé au présent article. Article 46: La résolution du Congrès du PDI portant sa dissolution est prise par les 4/5 de ses membres présents à la réunion du Congrès à laquelle participent au moins les ¾ de ses membres. Article 47: Délégations des pouvoirs Chaque organe du PDI peut temporairement déléguer ses pouvoirs à un autre organe du PDI qui lui est inférieur. L’acte de délégation des pouvoirs indique les pouvoirs délégués. Article  48: Collaboration avec d’autres formation politiques La décision du PDI de se coaliser avec une ou plusieurs formations politiques lors des élections ou à des fins de conquérir le pouvoir est prise par le Bureau Politique du PDI. La décision de fusionner le PDI avec une autre formation politique est prise par la réunion du Congrès dans les mêmes conditions que celles applicables à la dissolution du PDI. Article 49: Dissolution du PDI En cas de dissolution du PDI, ses biens et avoirs sont confiés à une autre formation politique ou à une organisation sans but lucratif déterminé par le Bureau Politique du PDI. Article 50: Pour les matières qui ne sont pas prévues par la Constitution de la République du Rwanda, par la Loi Organique régissant les formations politiques et les politiciens, par les présents Statuts et par le Règlement d’Ordre Intérieur du PDI, les décisions des organes du PDI restent applicables compte tenu de l’ordre hiérarchique de ces organes. Article 51: Entree en vigueur des présents Statuts Les présents Statuts entrent en vigueur le jour de leur approbation par l’organe de l’État compétent.
